A Winnebago County man accused of raping a five-year-old was taken into custody at the order of Kenosha County Circuit Court Judge Anthony Milisauskas today. Dakari S.D. Childress was first charged with First Degree Sexual Assault of the late Zha’riyah Robinson, 5, of Kenosha on February 2, 2024.

Kenosha County Circuit Court Commissioner William Michel II gave Childress a no-cash bail, meaning that he was set free into the world without having to pay a cent. ADA Alexandra Smathers, the prosecutor on the case, was OK with the no-cash bail, until the family of Zha’riyah and readers of this publication pushed back. Smathers told the family that there was “no basis” to ask for a higher bail. KCE published an article about a disturbance that occurred at the last hearing on May 29, 2024. Finally, five days later, Smathers made a motion asking for the bail to be increased.
As a basis for the motion, Smathers sent a photo of Childress from his Facebook account holding what looks like a gun. She didn’t, however, show the judge the multiple videos of him holding a gun and drugs. They were sent to her by a citizen, but she ignored the communication. The video is below:
In court today, Childress told the Judge that his phone was “robbed” from him and someone got his password and this mystery person was posting the videos and photos that he said were “old.” The photo that Smathers sent the judge showed Childress in dreadlocks, which Childress says were cut off long ago.

The Judges wasn’t convinced and cited the need to protect the public and the seriousness of the accusations as his reason for increasing Childress’ bail to $25,000 cash.

So, what happened to baby Zha’riyah Robinson? We know she was a cute, spunky, sweet and beloved little five-year-old little girl. We know she was brutally sexually assaulted on August 22, 2023, and unfortunately, passed away less than three months later on November 16, 2023 in Surprise, Arizona. What we don’t know is how she died. In court today, Assistant District Attorney Alexandra Smathers called Zha’riyah’s death “suspicious.”
A highly skilled sexual assault nurse who spoke with KCE said that the death could be linked to her rape, which was oral, vaginal, and rectal. A rectal tear could cause a slow and terrible death under certain circumstances.

According to the criminal complaint, then-15-year-old Dakari S.D. Childress was briefly watching Zha’riyah at a home in Kenosha. He was then alleged to have brutally raped her in every possible way. Zha’riyah was able to depict to Kenosha Police exactly what happened.
Childress was charged as a juvenile at first, but Judge Meier sent him to be tried as an adult. He made his initial appearance as an adult on February 7, 2024.

“We handled a sexual assault case with Childress as a suspect []. After our conversation, I spoke with a couple [of] detectives and found that Surprise PD in Arizona is investigating the child’s death,” said KPD Spokesman Lt. Josh Hecker.
KCE reached out to the Surprise, AZ police department. Sgt. Rick Hernandez released the following statement:
“This investigation is still open and is pending the full medical examiner’s report. Here is a summary of the SPD investigation to date.
On 11/16/2023, Officers responded to a local urgent care after Zha’riyah became unresponsive. Upon arrival, Officers observed medical staff attempting life-saving measures. Zha’riyah was transported to a local hospital in critical condition, where she later passed away. Detectives from the Surprise Police Department responded, interviewed her guardian, medical staff, and executed a search warrant of Zha’riyah‘s residence. On 11/18/2023 an autopsy was conducted. While the full medical examiner’s report is not complete, the medical examiner did not find any obvious signs of new trauma.
Throughout this investigation, Surprise PD investigators have been in contact with Kenosha PD regarding Zha’riyah’s past family history.”

Timothy Stark, Zha’riyah’s Grandfather told KCE today that a weight was lifted off of his chest seeing Childress placed in handcuffs by Sheriff’s Deputies. “It’s a good thing and safer for the public,” Stark said after the hearing.
Stark told KCE that the Robinson family recently had a family reunion in Texas where Zha’riyah’s life was celebrated.
Childress is now without an attorney, as the Kenosha Public Defender’s Office has discovered a conflict, so the case is now in limbo, as attorneys are in short supply.
He is due back in court on July 15, 2024 to see if he’s secured an attorney.
