RANDALL, Wis. — A 19-year-old Twin Lakes man accused of drunkenly swerving a vehicle before causing a near-deadly rollover crash that seriously injured multiple passengers—and then fleeing the scene—was taken into custody Thursday afternoon after Court Commissioner William Michel II had already ordered a $30,000 cash bail following felony charges.


Joshua M. Bivens, 19, of Twin Lakes, was formally charged April 15, 2026, after prosecutors sought an arrest warrant tied to the April 12 crash. Michel set bail at $30,000 cash the same day. Bivens remained on the run for more than a week before being taken into custody Thursday afternoon. Authorities have not released details of how or where he was arrested. He is expected to make his initial appearance Friday, April 24 at 1 p.m.
According to the criminal complaint, the crash occurred at approximately 5:44 p.m. near the intersection of County Highway O and County Highway P in the Town of Randall. Deputies arriving on scene found a 1997 Toyota 4Runner overturned on its roof with eight occupants who had already exited the vehicle.
Two passengers were found lying on the ground with serious injuries, covered in blankets and being treated by rescue crews. A Flight for Life helicopter was requested but could not respond due to poor weather conditions. Emergency responders ultimately treated multiple victims and transported them to hospitals across the region, with injuries ranging from minor to critical.
Investigators allege Bivens was behind the wheel and had been drinking from a “Buzzball” alcoholic beverage while intentionally swerving the SUV back and forth on the roadway before losing control. Witnesses told deputies the vehicle began rolling after Bivens lost control, with at least one occupant being ejected during the crash. All occupants reportedly suffered injuries.
One victim may have sustained a fractured skull, while another required fentanyl for severe pain at the hospital. A third victim was diagnosed with a possible concussion, according to investigators.
Witnesses also reported that Bivens had been driving erratically on purpose and at speeds estimated around 68 miles per hour prior to the crash. Physical evidence at the scene—including tire marks and roadway damage—was consistent with the vehicle leaving the roadway, re-entering, and ultimately overturning multiple times before coming to rest upside down.
Authorities say Bivens fled the scene on foot immediately after the crash. Despite multiple deputies responding, he was not located that night.
In the days that followed, Bivens remained wanted on the $30,000 cash warrant, while friends and family publicly urged him on social media to turn himself in. He was ultimately taken into custody Thursday afternoon, though officials have not disclosed whether he surrendered or was apprehended.
Bivens now faces seven counts of first-degree recklessly endangering safety, all Class F felonies, along with three counts of hit-and-run causing injury and one count of misdemeanor bail jumping for allegedly committing the offenses while already out on bond in another case.
Each count of first-degree recklessly endangering safety carries a maximum penalty of 12 years and six months in prison. The hit-and-run charges each carry up to nine months, and the bail jumping charge carries up to nine months.
If convicted on all counts, Bivens faces a combined maximum exposure of more than 90 years in prison, in addition to tens of thousands of dollars in potential fines.
The crash remains under investigation by the Kenosha County Sheriff’s Office, and additional details surrounding Bivens’ arrest are expected to be released.
