Kenosha Man Accused of Brutal Beating Given $2,500 Bail Despite Immigration Concerns

KENOSHA, Wis. – A 31-year-old Kenosha man accused of severely beating another man during a family gathering was given a $2,500 cash bail during his initial court appearance Friday.

Victor Alfonso Lopez-Lopez is charged with felony substantial battery for allegedly punching a man about 20 times in the head on May 8, according to a criminal complaint filed in Kenosha County Circuit Court. The attack left the victim with a deep gash above his left eye that required stitches, swelling to his jaw, and heavy bleeding.

Deputy District Attorney Drew Burgoyne told the court Friday that the case was “a violent felony offense of substantial battery,” adding that an officer saw “a large amount of blood” on the victim’s face. He also raised concerns about Lopez-Lopez’s immigration status.

“There is an alien removal action out of the state of California from last year,” said Burgoyne. “Under that, I have reason to believe the defendant may be at risk to return to court.”

Burgoyne recommended a $20,000 cash bond and requested conditions including no alcohol and no contact with the victim or his residence.

Court Commissioner Donald Bielski ultimately set bail at $2,500 cash, citing the pending immigration matter. “From what Mr. Burgoyne tells me, it sounds like he’s not a citizen,” said Bielski. “So I have concerns that… if they removed him in California, there’s no reason why they can’t remove him here. I’m concerned that he’s not going to make it to court because he’s not going to be here.”

Bielski also ordered Lopez-Lopez to have no contact with three individuals connected to the case.

According to the complaint, the incident happened at a residence near 63rd Street and 27th Avenue, where Lopez-Lopez allegedly intervened in what he thought was an argument between a man and his wife. He told police he believed the man was choking the woman and struck him in response. However, the woman denied being choked and said the defendant was intoxicated and misunderstood the situation. Other witnesses also said they saw no choking.

District Attorney Xavier Solis told Kenosha County Eye that his office routinely asks for higher bail in serious criminal cases involving defendants with outstanding immigration issues. He said the goal is to ensure prosecution and sentencing occur before possible deportation. “When someone accused of a serious crime is subject to deportation, we want to ensure they’re held accountable here before they’re sent back to their country. If they are deported before prosecution, we pursue arrest warrants to ensure they’ll face charges if they return,” Solis said.

If convicted, Lopez-Lopez faces up to 3 years and 6 months in prison and a $10,000 fine. His preliminary hearing is scheduled for May 14.
