KENOSHA, Wis. — A Chicago man accused of stabbing another man outside the Kenosha train station in 2023 has been declared incompetent to stand trial once and is now facing a second competency review request after being re-arrested last week following nearly a year on the run.
According to a criminal complaint, 23-year-old Julian Ivan Martinez is charged with substantial battery with use of a dangerous weapon and disorderly conduct with use of a dangerous weapon. Prosecutors say Martinez stabbed a man in the hand during a July 26, 2023, confrontation outside the train station on 13th Avenue, after accusing him of stealing a phone.
The victim told police Martinez threatened to shoot him, then pulled a 3- to 4-inch pocketknife and slashed his hand, causing a laceration that required stitches. Police later recovered the knife and noted Martinez identified himself as a Latin Kings gang member.
Martinez was charged and given $5,000 bail on July 27, 2023. Less than a week later, his defense attorney raised concerns about competency. On Aug. 25, 2023, Judge Gerad Dougvillo found Martinez incompetent but likely to regain competency with treatment, ordering outpatient restoration and requiring him to live with his sister in Racine under restrictions around children. His bail was reduced to $2,500, and he posted it on Aug. 28.
Martinez failed to appear in court on Nov. 17, 2023, and Jan. 31, 2024. A $10,000 bench warrant was issued, and he was not brought back before a commissioner until Aug. 7, 2025, when he appeared before Court Commissioner William Michel II. At that hearing, Michel ordered a new competency evaluation. Martinez’s bail is now set at $10,000 cash, and he is scheduled to return to court on Aug. 21, 2025.
