Kenosha Police Address Viral Video Of Officers’ Use-of-Force Inside Restaurant

A video that appears to show a Kenosha Police Officer punch a man several times in the head has gone viral on social media. The video was sent to KCE by many readers.

Kenosha and Pleasant Prairie police officers responded to a major car accident at the corner of Green Bay Rd and Highway 50. Witnesses reported a man, woman, and small child fleeing the area, making it a hit-and-run. Kenosha and Pleasant Prairie Police officers entered the nearby Applebee’s restaurant and found a man, woman, and child that matched the description sitting at a table. The video picks up several minutes after the initial conversation between police and the family:

In the video, it appears a man is holding a small child and refuses to listen to the police’s commands. Eventually employees of the restaraunt got the baby safe and the man is taken to the ground. One Kenosha Police officer seems to strike the man several times in the head. The man begins to groan and appears to have urinated on himself.

Reached Saturday, Kenosha Police Chief Patrick Patton says that he is aware of the incident at Applebees and it’s under review. Patton said experts on use-of-force are in the process of examining the officers’ actions. The Department’s Office of Professional Standards (Internal Affairs) is also aware of the incident and are reviewing it.

The 24-year-old man from the video and his 21-year-old girlfriend were both charged by the Kenosha County DA’s office on July 21, 2023. The man was charged with resisting/obstructing and disorderly conduct. The woman received identical charges and was also charged with possession of THC. At this time, KCE is not naming the two involved people, who live together in Zion, IL.

Kenosha Police later located the actual hit-and-run suspect(s) in the nearby bathroom inside the restaraunt. We will update you when the review is completed.

  1. Before the inevitable comparisons are drawn, the initial report indicates that, unlike the Jacob Blake case, the police did not have a warrant here and, in fact, got the wrong guy. We’ll see how this plays out. I have many unanswered questions. Can’t wait for more facts.

    1. Do you actually believe that the police need a warrant to go into a restaurant and look for someone who ran away from a hit-and-run accident? I can just imagine if the cops came to your house for breaking and entry and someone ran out the back door and into McDonald’s. You’d be okay with the cops breaking off the chase and zooming off to find a judge who’d sign a warrant, or them just standing outside the McDonald’s saying, I hope this doesn’t turn into a hostage situation but we can’t go in there without a warrant even though people are walking past us and going in for a burger. Looks like there’s going to be plenty of blame on both sides, but the money will come from the deep pockets, the taxpayers. If you know you’re innocent, there’s no law saying you can simply ignore an officers lawful commands because you know you didn’t do it. Unfortunate as the whole situation turned into, it didn’t have to go down that way but we have perpetuated lies, Miss truths and simple ignorance regarding what you do and don’t have to do when a cop asks you your name or even temporarily restrains you until they can determine whether or not you pose a danger.

    1. The article says that the perpetrators of the hit and run were caught elsewhere. Early information indicates that this couple and their child were merely dining at a restaurant. The cops had the wrong guy. The woman having marijuana, while illegal in Wisconsin, isn’t exactly a major drug bust.
      Also, what are you referring to as “impossible”?
      I’m staying tuned to the Eye for more details. This must have been a shock to these people. One minute, they’re eating at a below-average restaurant. The next minute, a cop is literally beating the piss out of a guy, at least according to the story. Another minute later, they’re being thrown in the slammer.

          1. Quite honestly, it does not matter what she did. Professionals who work with children must still conform to a standard of care when they deal with a student’s bad behavior. That standard of care does not include kneeling onthe student’s neck for an extended period of time. Just because the child was acting like a child does not make it ok to kneel on her neck. There is no way to justify that behavior from a trained professional officer.

During the video the couple in question do not respond to officers command . Thus becoming a law breaking matter . Please read all the material and watch the video.

Re: the crime of resisting, at trial the state would have to prove, beyond a reasonable doubt, all elements of the crime, including that “[t]he defendant KNEW that officer was an officer acting . . . with lawful authority . . .” J.I. Crim. 1765 (emphasis added). In other words, there’s a knowledge element to this crime.

    There could very well be a defense IF the defendant was merely eating in a restaurant and he was blitzed by a cop for reasons unknown to the defendant. Therefore, this case may hinge on what the officer told him before the above video started. (I’m sure every cop, including the pugilist cop, had a bodycam that will eventually be made available to the defense.)

    Can’t wait to see more videos as they’re released to the public.

    1. I agree with Attorney Cicchini’s cautious approach. I would emphasize that the officer must act in an official capacity and with LAWFUL AUTHORITY. Here, official capacity is not an issue, so was there lawful authority?

      Under Wisconsin law, a police officer who has a reasonable and articulable suspicion (lesser standard than probable cause) that a person is committing or has committed an offense may stop and temporarily detain a person to inquire as to their identity and obtain an explanation.

      Near the scene people matching the description are found in a restaurant. Arguably that’s a reasonable suspicion. Generally the temporary detention and questioning must be done in that vicinity. Because we have only seen the back end of a video we don’t know if the officers acted properly or not. We saw an escalated situation which does not fit the normal temporary detention for questioning. So what’s the rest of the story? Once we get that then we can make an informed assessment.

If he would have cooperated there wouldn’t have an incident. When are people going to understand when you don’t cooperate and start fighting you can get hurt or worse. Give them your license, show them your vehicle. Even if you get wrongfully charged, you work it out in court. They can trace the vehicle back to whoever owns it.

    1. Why is it that the police are not releasing the name of the man who was falsely accused/beaten and the persons who actually commited the crime? Is it because that information can’t be released until the investigation is complete?

    2. If I know I did not commit a crime and the police stop to question me, what am I obliged to do? Under the law, am I required to stop and answer their questions? Or, do I have the right to refuse answering their questions and walk away? (Knowing the safest thing to do in most cases is to cooperate.)

If police have reasonable articulable suspicion that you have committed a crime are committing a crime or are about to commit a crime, they can temporarily detain you to investigate.     So is there a reason why they have not named the driver of the fatal crash last week? The word is out that the 20 year old driver had two previous duis and his parents bought the alcohol they all drank. Have they been arrested? Has the driver? Do they have money?

Also, why have they not yet named the officers involved with the in custody suicide? The corruption in Pleasant Prairie is out of control. John Steinbrink Jr. gets charged with embezzling tens of thousands of dollars and people get ordered not to talk about it (some paid hush money). That investigation gets referred to Racine County. A man commits suicide while in custody and the no information is released. Not even the names of the officers responsible. That investigation also gets referred to Racine County. Now a Pleasant Prairie Sergeant is involved in a wrongful arrest involving police brutality and the sergeant isn’t even named in the incident or investigation. Doesn’t anyone think that Smetana’s ties to Racine agencies are a conflict of interest for them to be investigating cases from Pleasant Prairie? Why aren’t those cases referred to Kenosha County Sheriff like other agencies in the county?

  33. You need to look into Attorney Brenda Vancuike and her girlfriend stealing a baby from one of Brenda’s clients. Brenda needs to be brought before an ethics committee and should not be allowed to defend any CHIPS, DCFS or TPR cases. Brenda crossed many lines and what they pair did was illegal.
