Kenosha Judge Hands Dangerous Felon Just Over 10 Months Jail in Trio of Violent Cases — ADA Dismisses Most Serious Charges

KENOSHA, Wis. — A Kenosha judge sentenced a repeat felon Monday to just over 10 months in jail, despite convictions in three separate criminal cases involving sexual assault, stalking, intimidation, drunk driving, and multiple violations of felony bond.

Jason T. Barnhill, 44, faced more than 50 years in prison if convicted on all original counts. But under a global plea deal struck by the Kenosha County District Attorney’s Office, prosecutors dismissed many of the most serious charges—including second-degree sexual assault, false imprisonment, and felony witness intimidation—in exchange for guilty pleas to lesser offenses.

In total, Barnhill received 10.5 months in jail (6 months + 45 days + 90 days), all to be served consecutively, followed by 3 years of probation. The jail time includes work-release privileges, allowing Barnhill to leave the jail during the day if employed.

According to court records and criminal complaints, Barnhill:

  • Entered a woman’s home uninvited while intoxicated, sexually assaulted her, and slapped her
  • Later tried to coerce her into dropping the charges through dozens of jail calls—some recorded with his mother acting as a go-between
  • Threatened to disseminate humiliating information if she didn’t comply
  • Groped a second woman in a separate June incident, calling her a vulgar slur and a “worthless gold digger” when she resisted

Despite the severity and pattern of behavior, Kenosha County Assistant District Attorney Timothy Martin dismissed many of the most serious felonies, including second-degree sexual assault (a Class C felony) and felony intimidation of a witness (a Class G felony)—charges that carried decades of potential prison time.

Assistant District Attorney Alexis Bauer argued for a prison sentence, but Judge Rosselle didn’t want any prison time.

Instead, the judge allowed Barnhill—a man already convicted in 2024 of threatening women via phone and previously convicted of OWI three times—to potentially return home by next spring if he serves his work release time without infractions.

One longtime resident who reviewed the plea remarked: “This man broke into a woman’s home, assaulted her, threatened her from jail, tried to manipulate the justice system—and he’s getting 10 months of work release? The DA handed him a gift, and the judge wrapped it with a bow.”

  2. Since the public has no idea how court works, you cannot prosecute without evidence. The strategy for weak cases is to over charge for several crimes hoping the defendant with plead to a lesser charge prior to court. There’s a large majority of prisoners in jail facing decades of incarceration, and after they meet with their public inept defender, it is clear they should plead out and take a year or two instead of rolling the dice with a jury trial for decades in sentencing.

    Not everyone that goes to jail is guilty, not everyone who takes a plea deal is guilty, sometimes. Beyond reasonable doubt doesnt exist in online forums, y’all just want to lunch everyone accused.
