Embattled Attorney Ted Kmiec Quietly Removed from Supplemental Court Commissioner Role After Drug Raid

KENOSHA, Wis. – Embattled attorney and former politician Theodore “Ted” Kmiec is no longer serving as a supplemental court commissioner in Kenosha County, according to records obtained by Kenosha County Eye through an open records request. In a January 14, 2025 email, the Kenosha County judge who had appointed Kmiec wrote, “Ted Kmiec will no longer be serving as my supplemental commissioner.”

The removal comes on the heels of a SWAT raid that uncovered a substantial quantity of drugs inside Kmiec’s Salem Lakes home. According to law enforcement sources and court documents previously reported by KCE, illegal substances were found in multiple rooms of the residence—his bedroom, office, living room, and kitchen. Kmiec did not deny ownership of the drugs and stated that only he had access to all or some of the areas where they were discovered.

The December 2024 raid was part of a broader criminal investigation related to Kmiec’s adult son, who was later charged with 58 felonies, including serious child sex crimes. The Sheriff’s Department SWAT team executed the search warrant early one morning, and law enforcement described the scene as one involving not only disturbing allegations of sexual abuse, but also a home filled with illegal drugs and drug paraphernalia.

Despite the magnitude of the raid and the admissions by Kmiec, there has been no indication that criminal charges will be filed against the attorney himself. This lack of accountability has fueled criticism from community members and legal professionals alike, particularly given Kmiec’s former political influence and his prior role as a supplemental court commissioner.

Each Kenosha County Circuit Judge is allowed to appoint two supplemental court commissioners to assist with depositions and to fill in when full-time commissioners are absent. Kmiec had been one of these appointees—an honorary but trusted role within the judiciary.

Kmiec’s removal marks yet another low point in a long string of controversies. His tenure as a public figure has been marred by scandal, including his connections to what many see as preferential treatment for his son in multiple legal matters. In one case, his son received what some characterized as a “white glove” sentence after being convicted of seven felonies in Fond du Lac County.
