Enwright to Challenge Jail Sentence, Files Notice of Postconviction Relief

Kenosha, Wis. — Less than two weeks after being sentenced to 15 months in jail for grooming a middle school student, former Kenosha teacher Christian J. Enwright has formally initiated a legal challenge to the punishment.

On Thursday, Enwright’s attorneys filed a “Notice of Intent to Pursue Postconviction Relief” — a routine legal filing that signals the defense plans to ask Judge Gerad Dougvillo to reconsider the sentence, or, if that fails, to appeal it to the Wisconsin Court of Appeals.

Enwright’s brother, Grant Enwright, also ordered an expedited copy of the sentencing transcript this week, a move that suggests the defense team is preparing to file a motion in the coming weeks requesting a new sentence.

Enwright is currently serving a 15-month jail term imposed by Dougvillo on July 2, following his guilty plea to 15 counts of disorderly conduct. The judge denied Huber privileges, meaning Enwright cannot leave jail for work or childcare. The underlying charges involved inappropriate and manipulative Snapchat messages sent to a then-14-year-old student, now 15, identified by the pseudonym Holly.

To obtain postconviction relief in Wisconsin, a defendant must show that the sentencing judge made a legal error or abused their discretion — a legal standard that is exceptionally difficult to meet. According to legal experts, the Wisconsin Court of Appeals rarely overturns sentences, especially those involving misdemeanors.

If Enwright’s legal team files a motion for re-sentencing and Judge Dougvillo denies it, the case may be appealed. But multiple defense attorneys tell Kenosha County Eye that such efforts are usually unsuccessful and amount to a long-shot challenge.

“This is likely a waste of Enwright’s money,” one Kenosha-area attorney said, noting the strength and clarity of Judge Dougvillo’s justification during sentencing.

The court previously heard victim impact statements from Holly and her father, as well as a stern critique from the judge directed at clergy members who had written letters in support of Enwright. Dougvillo called a letter from Holly’s friend “the most impactful” of all.

The Kenosha County District Attorney’s Office, led by DA Xavier Solis, had requested a one-year sentence. Judge Dougvillo went beyond that recommendation, calling the conduct serious and the consequences lasting. Assistant District Attorney Sarah Norkus, who prosecuted the case, told KCE the sentence was just and appropriate.

Enwright remains in custody at the Kenosha County Detention Center. The federal civil lawsuit filed by Holly’s family against Enwright and the Kenosha Unified School District is ongoing.

    The reason Enwright was prosecuted for disorderly conduct is because the state statutes don’t cover what he did anywhere else. This isn’t the first time the statutes fell short and this will provide the legislature with an incentive to change the law. Rep. Nedweski likes putting out press releases. Maybe she can do some work now and try to fix this.

    The defense attorneys are essentially required to file the notice of intent to pursue post conviction relief. Doesn’t mean that they will but they have to cover their butt by doing it.
