KENOSHA, Wis. — A Kenosha woman is facing a felony forgery charge after allegedly cashing a counterfeit check from Snap-on for more than $1,400 at a local business earlier this month.
Nicole Marie Montoya, 40, was formally charged Friday in Kenosha County Circuit Court with one count of uttering a forgery, a Class H felony. Court Commissioner William Michel II ordered a preliminary hearing for July 30.
According to the criminal complaint, Montoya entered Westown Food on July 4 and presented a check made out to her in the amount of $1,452.56. The check appeared to be from Snap-on, and Montoya provided a photo ID with her name and address matching the one listed on the check. After taking a 2% fee, the business issued her $1,421.51 in cash.
On July 17, the store owner was notified by his bank that the check was fraudulent. Surveillance footage later confirmed that the woman who cashed the check matched Montoya’s booking photo, and she was identified as the same person who received the funds.
Montoya was arrested during a traffic stop on July 24 and interviewed the following day by a Kenosha Police detective. According to the complaint, she admitted to cashing the check and claimed she received it in the mail after speaking with someone who said she was entered in a sweepstakes to win up to $5,000. She said the call came from a toll-free number, but she couldn’t recall the name of the company.
Montoya told detectives she had moved into the address listed on the check on July 1, but admitted she had spoken to the alleged sweepstakes caller 2–3 weeks prior. When pressed on how she gave that address to the caller before living there, Montoya gave what police described as a “convoluted” explanation.
Detectives also confirmed with Snap-on’s human resources department that Montoya had never been employed by the company.
If convicted, Montoya faces up to six years in prison and a $10,000 fine.
