
RACINE, Wis. – Former Racine Police Officer LaVontay Fenderson, who was charged last week with embezzling over $16,000 from the Racine Unified School District, failed to appear in court today for his scheduled initial appearance. As a result, a warrant was issued for his arrest.
Fenderson was due in Racine County Circuit Court at 2 p.m. for a hearing before Court Commissioner Alice Rudebusch. Instead, he was a no-show.
Fenderson had not been arrested at the time the charges were filed. Instead, he was issued a criminal summons by the Kenosha County District Attorney’s Office, which is prosecuting the case after Racine County District Attorney Patricia Hanson declined to bring charges.
Despite the active warrant, law enforcement sources tell Kenosha County Eye that Fenderson is not being actively sought by police at this time and is not considered a wanted fugitive. The warrant simply authorizes law enforcement to arrest him if encountered.
Commissioner Rudebusch, a progressive judicial officer known for her lenient bail practices, was reportedly prepared to offer Fenderson a signature bond had he appeared in court. However, that may no longer be on the table once he is taken into custody.
Fenderson is facing one count of theft by false representation and one count of misconduct in public office for allegedly billing both the Racine Police Department and RUSD for the same work hours over a nearly two-year period. The charges stem from a Kenosha Police investigation that documented 72 instances of double pay and over $16,000 in losses to the school district.
He resigned from the Racine Police Department on May 27, 2025, months after the scheme had been uncovered. His initial appearance will be rescheduled once he is taken into custody or voluntarily appears before the court.
