Editor’s Note (Added October 25, 2026, at 7:44 p.m.): On October 21, 2026, the criminal OWI case against Michael Shawn Guilfoil was dismissed by Kenosha County Circuit Court Judge Jason Rossell (D) after prosecutors requested an adjournment of the trial. Guilfoil’s defense attorney objected to the postponement, and following arguments, the prosecution moved to dismiss the case. The judge granted the dismissal. The dismissal was not a decision on the merits of the allegations. Guilfoil was not acquitted or found not guilty by a judge or jury. Rather, the case was dismissed before a trial could take place. The dismissal was without prejudice. Prosecutors retain the ability to refile charges, subject to applicable legal restrictions. It is unknown whether prosecutors intend to pursue the case again. There are numerous reasons prosecutors might request additional time before trial, including insufficient preparation time, the availability of witnesses, scheduling conflicts, or outstanding evidentiary issues. One possibility is that prosecutors were not prepared to proceed on the scheduled trial date. However, the specific reason for the prosecution's request in this case has not been established. The original article below accurately reported the criminal charges filed against Guilfoil in September 2025, based on the official criminal complaint and court records available at the time. The charge was subsequently reduced from felony fourth-offense OWI to misdemeanor third-offense OWI before the criminal case was dismissed.
