KENOSHA, Wis. — Newly released body-worn camera footage sheds additional light on the July 11 OWI arrest of Jacqueline Niccolai, a licensed therapist and former foster parent who is already facing criminal charges for violating a harassment injunction and is under investigation by the state licensing board. The crash was determined to be Niccolai’s fault.
The incident occurred shortly before 10:02 p.m. at the intersection of 89th Street and 30th Avenue. Officers responded to a two-vehicle crash and found Niccolai behind the wheel of a green Ford Expedition. The driver of the other vehicle told police that Niccolai said she was the designated driver and needed to leave to go to Starlight, another bar, to use the bathroom. She then asked him not to call police and offered him cash to “settle it.” The other driver refused and told her to stay until police arrived.

Niccolai, who appeared visibly impaired in the video and had bloodshot eyes, admitted to officers that she had consumed alcohol and taken multiple prescription drugs, including Xanax, Vyvanse, and Hydroxyzine. Her speech was slurred, and her behavior erratic. At one point, she attempted to perform a field sobriety test but failed spectacularly—trying to do the moonwalk instead of completing the instructed walk-and-turn. She stumbled throughout the roadside evaluations.

During the investigation, Niccolai pleaded, “Please do not do mugshots.”
Later, she told a friend that she was afraid cocaine would show up on her blood test, saying, “This OWI would completely go away but there’s a good chance [cocaine is] going to come up in my bloodwork which will fuck me.”
History of Dangerous Behavior
Niccolai’s arrest was not her first encounter with law enforcement. In 2024, she was arrested for carrying a firearm while intoxicated after police found her armed and impaired. While in custody, she kicked the inside of a squad car more than two dozen times and threatened to kill police officers. She was booked and released after that incident, but prosecutors declined to file felony charges for threats or property damage.
Legal Representation and Plea
Niccolai has pleaded not guilty to the OWI charge. She is represented by attorney Theodore (Ted) B. Kmiec III of Kmiec & Noonan LLC, a Salem-based law firm. Niccolai told a friend he is working “pro-bono.”
Niccolai was booked into jail and released shortly after the July 11 crash. Her case remains open and pending blood-test results. She is also the subject of an ongoing investigation by the Wisconsin Department of Safety and Professional Services (DSPS), which regulates therapist licensure.
