KENOSHA, Wis. — A Kenosha man is facing multiple domestic-violence charges, including a felony count of strangulation and suffocation, after police say he woke his longtime girlfriend by screaming at her and then allegedly choked her for roughly 30 seconds while she struggled to breathe, according to a criminal complaint filed Wednesday. Despite the allegations, Commissioner Masnica gave him only a $500 cash bail in his initial appearance today.
There is growing concern among attorneys, reporters, and regular courthouse observers — including this author — that Judge Chad Kerkman may be influencing or encouraging commissioners to issue low or no cash bails, even in serious domestic-violence cases. To be clear, Kerkman has absolutely no legal authority to order commissioners to impose low bail, and no such directive would be permitted under Wisconsin law. However, the pattern has led many to question whether commissioners are adjusting their bail decisions based on perceived expectations rather than judicial independence. Masnica, who was once known for imposing significantly higher bails in violent-crime cases, now appears to be following that trend.
