KENOSHA, Wis. — A Silver Lake man, Julio N. Gutierrez, 45, was charged Friday in Kenosha County Circuit Court with ten Class D felonies of possession of child pornography. District Attorney Xavier Solis asked Court Commissioner William Michel II to impose $300,000 cash bail; Michel set bail at $100,000 cash. A preliminary hearing is set for November 21.
According to the criminal complaint, the case began with multiple CyberTip reports from WhatsApp and Snapchat routed through the National Center for Missing and Exploited Children (NCMEC) to Wisconsin authorities. Investigators then pursued a series of search warrants for account contents and subscriber records. Records from telecommunications and internet providers tied the reported activity to a phone number and IP address associated with Gutierrez and a residence in the 700 block of Lakeview Drive in Silver Lake.
The complaint states that investigators executed a search warrant at the residence and seized electronic devices. Forensic review identified numerous video files depicting minors engaged in sexually explicit conduct, including repeated uploads of the same child-sexual-abuse videos on different dates. The charging language specifies ten separate counts under Wis. Stat. § 948.12(1m) and (3)(a).
The complaint also documents a Nov. 11, 2025 arrest at about 8:30 p.m. on an out-of-state (Arizona) warrant. After the arrest, investigators reviewed the phone in Gutierrez’s possession with his consent to confirm linked accounts that had appeared in the cyber-tip and provider records. (The complaint lists an alias of “Julio Nieto Nieto-Gutierrez.”)
If convicted, each of the ten Class D felony counts carries up to 25 years in prison and a $100,000 fine, for a statutory maximum of up to 250 years. In addition, Wis. Stat. § 939.617 requires a mandatory minimum of three years in prison per count, which equals a mandatory minimum of 30 years across the ten counts if convicted of all charges. The complaint also notices the $500 per-image surcharge under Wis. Stat. § 973.042(2), to be determined by the court.
Gutierrez’s listed residence in the complaint is Silver Lake, Wisconsin. He remains in custody on the $100,000 cash bail order.
