KENOSHA, Wis. — New documents filed in court Tuesday reveal that the deadly apartment fire that killed three young siblings at 5221 43rd Avenue was initially being handled as a potential arson resulting in homicide, as investigators continue analyzing evidence and statements in a case that has shaken the city to its core. According to a Kenosha Police spokesman, however, the department is leaning away from arson or homicide as the cause of death.
In response to public release of the newly filed search warrant, Kenosha Police Lt. Josh Hecker issued a clarification Wednesday afternoon, stressing that the document lists homicide and arson because Wisconsin law requires investigators to cite potential criminal charges when applying for a warrant. Hecker emphasized that detectives “approach every case through a criminal investigative lens,” and that the phone seized from the home — which the warrant authorized for possible evidence of homicide and arson — did not reveal any criminal activity related to the fire. He added that investigators are still examining whether the tragedy was accidental and that detectives “will continue to methodically rule out all possible causes” alongside Kenosha Fire Department investigators.

He should still be found negligent and that he caused their deaths. He had young children, so he was responsible for ensuring there were working smoke detectors and working fire extinguishers. If the fire was so “small tiny almost,” why run for help? We all know as adults how to put out a fire. There are so many questions and no reasonable answers.

Wow. Really nice language to use in a video when you are trying to defend someone. I had horrible feeling about this situation. I feel terrible for these children. But as a father, I would have burned to death getting my children out of a house that was on fire. So, if it was a small fire when he first seen it. Why didn’t he get them out then? And how long was he gone for that the fire pushed him back out the door? I think we all know what is coming next.

There may (or may not) be a bit too much read into this at this point but that’s understandable because of the convoluted law about fire investigations. While firefighters are at the scene putting out a fire and cleaning up they don’t a warrant and this usually includes the basic on the scene investigation to determine the cause of the fire. If firefighters return then, in the absence of specific consent, they need a warrant. If it’s to continue the routine fire inspection it’s a simple special inspection warrant but if there’s a criminal investigation then they are taught to go for a search warrant. Why??? If the investigation turns up evidence of a crime then they did the right thing. If not, it was better to have a search warrant and not need one than to need one and not have it. So it may be too soon to tell right now. Or not.
Just like all fires, the fire investigator will find it to be an electrical fire. They say that when they cannot find answers.
