Former County Supervisor Andy “Sergeant Hard” Berg Arrested In Major Drug, Gun Case After Lengthy KDOG Investigation

KENOSHA, Wis. — Former County Board Supervisor, former Corrections Sergeant and former candidate for County Sheriff, Andy “Sergeant Hard” Berg was arrested Friday following a lengthy narcotics and firearms investigation that culminated in a search warrant execution in the city of Kenosha, according to law enforcement.

Detectives with the Kenosha Drug Operations Group executed a search warrant in the 2900 block of 31st Avenue after what authorities described as a prolonged and intensive investigation into alleged drug trafficking and illegal firearms activity. Berg, 47, a Kenosha man, was identified as the target of the investigation.

According to investigators, KDOG detectives conducted multiple controlled purchases in which Berg allegedly sold illicit narcotics to a confidential informant. Authorities say the substances involved included marijuana, psilocybin mushrooms, and GHB — commonly referred to as “liquid G” and widely known as a date rape drug. Investigators further allege Berg knowingly transferred multiple firearms to an individual prohibited from possessing firearms.

During the execution of the search warrant, investigators reported recovering evidence consistent with narcotics trafficking, including drug packaging materials and ledgers. Because a child resided at the home, the Kenosha County Sheriff’s Office Sensitive Crimes Unit responded to the scene and is handling that portion of the investigation.

Berg was taken into custody later the same day at the Kenosha County Courthouse without incident and booked into the Kenosha County Jail. His girlfriend, Laura Mercado, 41, a Kenosha woman, was also taken into custody and jailed in connection with the case.

Authorities say Berg is being referred on numerous felony charges, including multiple counts related to the manufacture and delivery of controlled substances, possession with intent to deliver, illegal firearm transactions, second-degree reckless endangering safety, possession of drug paraphernalia, possession of nitrous oxide, and maintaining a drug trafficking place. All charges include penalty enhancers alleging the offenses occurred within 1,000 feet of a school. The case is also under review for potential federal prosecution with assistance from the Drug Enforcement Administration and the Bureau of Alcohol, Tobacco, Firearms and Explosives.

The arrest represents the most serious development yet in a long-running series of legal, ethical, and criminal controversies involving Andy “Sergeant Hard” Berg, whose public downfall has unfolded over several years.

Berg is a former Kenosha County Board supervisor who also worked as a corrections sergeant for the Wisconsin Department of Corrections. His nickname, “Sergeant Hard,” became widely known after it was revealed that Berg had been producing and performing in explicit pornographic content while employed as a state corrections officer. Court records and reporting later showed Berg operated as an amateur porn performer and content creator, distributing sexually explicit material online under variations of the “Sergeant Hard” moniker. The content was not limited to private activity; it was marketed, monetized, and publicly accessible, creating a scandal that ultimately led to his termination from the Department of Corrections.

The pornography revelations were only one component of a broader pattern of misconduct allegations. Berg was later accused of sending unsolicited explicit images, including a photograph of his genitals, to a Black Lives Matter activist, which resulted in further public backlash and allegations of sexual harassment. That incident added to mounting questions about Berg’s judgment, conduct, and fitness for public office.

As his personal scandals mounted, Berg also became embroiled in a series of financial and legal disputes. He was accused in civil court of stiffing contractors and professionals, including allegations that he failed to pay thousands of dollars owed to a lawyer and other service providers. In separate proceedings, a judge ordered Berg to serve 120 days in jail over unpaid child support, further deepening his legal troubles.

Berg’s tenure on the County Board also ended in controversy. He lost his seat following a recount that confirmed his electoral defeat, and he was later accused of violating election laws by allegedly using taxpayer resources for campaign purposes. Additional allegations surfaced that Berg embezzled tens of thousands of dollars from a charity connected to him, prompting investigations and public scrutiny that continued even after he left office.

Berg also became a central figure in multiple public records disputes. Kenosha County Eye sued Berg over his failure to comply with Wisconsin’s public records law, ultimately winning court orders compelling him to release records and pay fees. When Berg failed to comply with those orders, he was found in contempt of court, further reinforcing a pattern of disregard for legal obligations.

At various points, law enforcement agencies recommended felony charges related to financial misconduct, while prosecutors in other jurisdictions reviewed potential criminal cases tied to Berg’s activities. Those matters remained unresolved or pending as additional investigations unfolded.

Friday’s arrest now places Berg at the center of a sweeping narcotics and firearms case that investigators say involved repeated drug sales, dangerous controlled substances, and the alleged transfer of firearms to prohibited persons — conduct authorities say posed a direct threat to public safety.

Law enforcement officials emphasized that the KDOG investigation reflects sustained cooperation among local, state, and federal agencies aimed at dismantling drug trafficking operations in Kenosha County.

Judicial Conflict?

Questions have already surfaced about potential judicial conflicts in Berg’s case due to his close personal and financial ties to Deputy Chief Judge Chad Kerkman. Berg and Kerkman are longtime friends, and Kerkman previously donated to, solicited donations for, and helped raise money for Berg’s now-defunct Garden of Eatin fundraiser, a charity Berg was later accused of stealing from. After revelations emerged that Berg operated a homosexual pornography account under the “Sergeant Hard” persona, Kerkman publicly offered words of encouragement on Facebook, writing, “I love how you are living your authentic life in your own way. This is a recipe for success in all you do. Keep being the example we need to see.” Kenosha County Eye has reached out to Judge Kerkman and Chief Judge Wynne Lauffenberg to ask whether Kerkman will recuse himself from any involvement in Berg’s case or whether he could play any role, similar to past controversy involving Kerkman’s former bailiff, Tammy Rose, who notably was not required to have a mugshot taken despite being accused of a felony.
