KENOSHA, Wis. — A late-breaking attempt to challenge Kenosha County Board Supervisor Felix Garcia in District 10 appears increasingly unlikely to gain traction after the would-be challenger was arrested on an operating while intoxicated allegation just days before the deadline to qualify for the ballot.

Just before Christmas, David Lux publicly announced on social media that he intended to run against Felix Garcia, a Racine County Sheriff’s Deputy who was sworn into office in 2024 and is widely viewed as well-liked within the district. Lux said he was collecting signatures to qualify for the ballot, but as of Monday he had not completed or submitted any official campaign paperwork. The deadline to do so is Tuesday.
District 10 generally encompasses the central portion of the city of Kenosha. Its northern boundary is Washington Road, the eastern boundary runs roughly along 24th Avenue, and the western boundary is approximately 43rd Avenue. The southern edge of the district is around 60th Street, placing the seat squarely in the middle of the city.

Kenosha County Eye attempted to contact Lux for comment but was unable to locate any direct contact information. If Lux contacts the publication, Kenosha County Eye will fairly credit and publish any statement he wishes to provide and will update this post accordingly.
In public Facebook posts from late December, Lux described his interest in issues such as mental health, homelessness, and community advocacy, and said he was seeking up to 150 signatures from registered voters in District 10 to secure a place on the ballot. He emphasized that signing nomination papers would not constitute a commitment to vote for him.
Since making those announcements, however, Lux was arrested and booked by the Kenosha Police Department on an allegation of first-offense operating while intoxicated. According to the Kenosha County Sheriff’s Department inmate inquiry, Lux was booked shortly after 1 a.m. on Jan. 4 and released later that morning after fines and costs were posted.
The arrest has quickly altered perceptions of the race among District 10 residents. Kenosha County Eye spoke with several residents in the district in recent days. Some said they already supported Garcia and planned to vote for him regardless of who appeared on the ballot. Others said they had been undecided but now could not imagine voting for a candidate who is going through the court process and potentially facing an OWI case.
Those residents said a pending criminal matter could signal other underlying issues and, at minimum, serve as a significant distraction from the duties of serving on the County Board. Even if Lux ultimately submits his nomination papers before the deadline, they said it would be extremely difficult for him to mount a viable campaign with an unresolved legal matter hanging over the race.

Garcia declined to comment on Lux’s arrest but offered a brief statement when asked about the situation.
“I don’t have any comment on his recent arrest,” Garcia said. “I wish him the best and hope he has a happy and healthy new year. My focus remains on serving the residents of District 10 and doing the job they elected me to do.”
Garcia, who took office in 2024 following his election to the District 10 seat, appears positioned to move forward without a serious electoral threat unless a challenger successfully qualifies before the filing deadline.
Update added Jan. 6, 2026, at 4:33 P.M. (CST)
Update: After publication, Kenosha County Eye received a written statement from David Lux addressing the operating while intoxicated case referenced in this article. Lux said the underlying OWI charge dates back to 2022, when he was 19 years old, and that the recent arrest stemmed from a warrant issued this year related to that earlier case, not a new OWI incident. Lux said he believed the matter had been resolved at the time after working with an attorney, completing required assessments, and submitting paperwork, and that he was unaware additional issues remained. He said the timing of the recent arrest understandably caused confusion. Lux said the original incident involved Delta-8, which is legal in Wisconsin, rather than alcohol. He said he has cooperated to resolve the case and believes it is now closed.

For democrats, an OWI arrest is a reason to vote for them.
So, our options are: 1) a sheriff’s deputy, or 2) someone who probably drinks and drives regularly (statistically speaking) and finally got caught.
Let’s take voting seriously folks, this is part of why the world is going downhill- IMO. Society functions best with guardrails, and those who dismiss them shouldn’t be the ones making policy decisions, we have seen how that ends all over the country.
Liberal policy becomes a burden on those that actually work and try to make their life better for themselves and their family. Stop with all this social justice nonsense, Society function best with the rule of Law, we will find those attributes in Felix GARCIA. Easy choice. Please, understand a DUI isn’t the ultimate sin, but it gives a glimpse to their decision-making skills, Vote Smart.
If they dont vote for him it will be because of racism, not this ! Remember. Racism is the reason for everything bad they bring upon themselves
I would like to believe we are long past judging people based on the color of their skin. Character matters.
Why not just get an uber? No reason for drunk driving in this day and age.
I worked with David lux at the Kenosha ymca. He is not a leader. His well off adoptive parents paid for his first 6 months of his own apartment, and he proceeded to get fired from the YMCA. He actually needs a lot of direction. He also lied to our boss about getting a girl pregnant.
Not really David Lux related but election related. Almost all municipal clerks are hired. Why is it that a county clerk who is the filing officer for so many positions and has so much to do with elections, is a partisan position? County board supervisors and county executive are “non partisan” but positions that have nothing to do with politics (register of deeds, treasurer) and the position that requires one to be non partisan are part of the partisan election. If I don’t trust democrats – how is one able to trust one with all of the county’s money, everyone’s vital records, and one to be honest and thorough with important elections?
Those positions are set up in the Wisconsin Constitution that way. If the citizens want it changed, it would have to be done by a Constitutional amendment.
Mental health, homelessness, community advocacy, blah,blah,blah… Nothing but liberal talking points that mean nothing. I think those were Sgt. Hard’s important issues too. Lux looks like a wanna be fraudster as well.
