Convicted Child Rapist Who Avoided Prison After Jury Trial Arrested on Probation Violation

KENOSHA, Wis. — A Kenosha man convicted by a jury of raping a child is back in custody after being arrested Thursday afternoon on a probation and parole warrant, years after Kenosha County Circuit Judge David Wilk allowed him to avoid prison and instead placed him on probation with jail time.

Jacob A. Hembel, 26, of Kenosha, was taken into custody March 19 on the warrant stemming from an alleged violation of his supervision.

Court records show Hembel was found guilty at a jury trial in July 2019 of first-degree sexual assault of a child under 12. The conviction stemmed from allegations that he engaged in repeated sexual conduct with a young child over an extended period of time.

Although the charge carried a potential sentence of up to 60 years in prison, the court imposed a 10-year prison sentence, followed by 15 years of extended supervision, but stayed that prison time and instead placed Hembel on 15 years of probation. He was also ordered to serve jail time as a condition of probation, which records indicate was largely satisfied through credit for time already served.

Hembel is required to register as a lifetime sex offender and is prohibited from having contact with minors or living in a residence with children.

His latest arrest stems from an alleged violation of those supervision rules. While details of the violation have not yet been released, the case raises renewed concerns about whether meaningful consequences will follow.

Cases like this are often handled administratively, and critics have pointed out that the Department of Corrections frequently declines to pursue full revocation, even in serious cases.

If his probation is revoked, Hembel would be ordered to serve the previously imposed 10-year prison sentence.

This young man was wrongly accused in the first place; of course no one knows that he was under the age of 12 when this allegedly happened, but yet charged as an adult. How f’d up is that and the court system for not allowing to share that information in the courtroom. They couldn’t even talk about the mother of the alleged victim. She was never around for the child. She just gave her child a device to watch to stay out of her way. At one point it was taken away from him by another adult because he was watching porn. The child’s mother was upset that it was taken away, she didn’t even know why, she was just out in her car getting stoned.
    I heard stories as I sat in the hallway. I also sat in the courtroom to listen. You can’t always believe the reporters and news, they don’t know either.
    The attorney that this young man had didn’t even try to defend him at all. I can only imagine how much they paid him to do nothing. That poor young man and his family and now he’s a sex offender the rest of his life. How unfair is this? All because no one wants to hear the whole story.
