KENOSHA, Wis. — Montgomery A. Winters, 33, of Kenosha, appeared in Kenosha County Intake Court on Wednesday in two separate misdemeanor gun-related cases stemming from unrelated incidents. One case will move forward on a disorderly conduct charge involving a firearm, while prosecutors dismissed the other after determining Winters had a valid concealed carry license at the time of the alleged offense.

ALLEGATION: “According to the criminal complaint, Winters told officers he believed several people were approaching him aggressively. He admitted pulling a handgun from his waistband, racking the slide, and asking, “What do you want to do?” He told officers he never pointed the gun at anyone. Witnesses likewise told police the firearm was not aimed at anyone but confirmed Winters racked the slide during the confrontation.”
THE LAW: “A person is privileged to threaten or intentionally use force against another for the purpose of preventing or terminating what the person reasonably believes to be an unlawful interference with his or her person by such other person. . . .” Statute 939.48.
What is going on here? What’s missing? Fill in the gaps, please. Someone. Please.
Given the state’s gaff re: the bogus carrying a concealed weapon allegation, my confidence on the other charge is near zero. Can the state be sued for stuff like this? I wonder what the law is on that point. Or are they immune, and free to charge anyone they want?
