KENOSHA, Wis. — In a stark contrast to her usual sentencing practices, Judge Jodi Meier followed Wisconsin’s mandatory OWI sentencing guidelines Friday, sentencing Scott D. Kumkoski, 64, to 60 days in the Kenosha County Jail after he pleaded guilty to third-offense operating while intoxicated. Meier also imposed a $600 fine plus court costs, revoked Kumkoski’s driver’s license for 24 months, ordered him to use an ignition interlock device for 12 months, and required him to complete an OWI assessment.
The conviction stems from a Feb. 6 crash in Pleasant Prairie, where police found Kumkoski’s disabled vehicle sitting in the center berm of a roundabout near Springbrook Road and 104th Street with smoke coming from the hood.
According to the criminal complaint, officers found Kumkoski standing next to the vehicle displaying signs of intoxication, including heavily slurred speech, glassy and watery eyes, and poor balance. Police also located an open can of Bell’s Two Hearted IPA beneath the vehicle and a tumbler inside the vehicle that tested positive for alcohol. Kumkoski admitted he was driving home from Johnny Z’s Pour House, where he had consumed two to three alcoholic drinks.
Kumkoski agreed to perform field sobriety tests but failed multiple portions of them. A preliminary breath test registered a 0.11 blood alcohol concentration. He was arrested for OWI, and a blood sample was later drawn for evidentiary testing.
Court records show Kumkoski’s prior OWI convictions occurred in 2017 and 2023, making this his third OWI offense.
In addition to the jail sentence, Meier credited Kumkoski with two days already served. She also ordered him to submit a DNA sample and pay the associated fee. The $600 fine was applied against the bond he had previously posted.
