Liberal Kenosha Alderman Anthony Kennedy Gets Restraining Order Against Sexual-Misconduct Accuser; Attorney Questions Filing

Whitney Cabal aka “Billy Volier” and Kenosha Alderman Anthony Kennedy (D), 59, of Kenosha

KENOSHA, Wis. — Kenosha Alderman Anthony Kennedy (D), 59, of Kenosha, has obtained a temporary harassment restraining order against Whitney Cabal after she publicly accused him of seeking sexual favors in connection with financial assistance. Kenosha County Court Commissioner Daniel “Catch & Release” Kellum signed the order, which follows a petition alleging that Cabal accused Kennedy of soliciting prostitution, called him a sexual predator, and threatened his two adult daughters.

The case is a significant development following KCE’s reporting on Cabal’s allegations and the text-message screenshots she published online. A civil attorney consulted by KCE questioned whether the limited allegations in the reviewed documents justified issuing the temporary order, while acknowledging that additional material could exist elsewhere in the record.

Kennedy filed the case under the name “Anthony Kennedy vs. Billy Violet,” using one of Cabal’s aliases. Court records list the case as 2026CV001380 and show a hearing scheduled for November 16 at 9 a.m. before Kellum in Pretrial Building Courtroom 157.

The order bears an October 30 signature date, while the public docket lists the case’s filing date as November 2. A docket notation states that the petition was electronically filed October 30, granted with a fee, and that the fee was paid November 2.

In the factual statement reviewed by KCE, Kennedy identified October 28 and October 29 as the dates of the most recent alleged conduct. He listed social media and text messages to his phone as the locations of the alleged harassment.

“The person has made allegation of soliciting prostitution, made allegations I am a sexual predator, has threatened my 25 year old and 38 year daughters,” Kennedy wrote. His statement did not reproduce the alleged threats or describe what Cabal allegedly said she would do to either daughter.

“I have been anxious of the verbal threats, I am worried about harm to my adult daughters,” Kennedy wrote in describing the effect on him. He added, “My employment has been threatened.”

Those allegations require distinctions that the short factual statement does not supply. Public accusations of misconduct, alleged threats of physical harm, and statements affecting someone’s employment involve different conduct, and the reviewed page does not explain the wording or circumstances of each.

The civil attorney who spoke with KCE said the temporary order should not have been signed based solely on the material reviewed. The attorney characterized the filing as appearing frivolous on that limited record, while emphasizing that unseen attachments or other information could change the assessment.

That is the attorney’s assessment, not a court finding. Kellum signed the temporary order, and the injunction hearing will provide an opportunity for the parties to present evidence and contest the allegations.

Wisconsin’s harassment statute uses a “reasonable grounds” standard for issuing a harassment injunction, rather than a general requirement of proof by clear and convincing evidence. The law includes a repeated-conduct route involving harassment or intimidation that serves no legitimate purpose, as well as separate grounds involving specified physical conduct or threats; two incidents are therefore not universally required in every harassment case.

The distinction matters here because Kennedy’s petition combines accusations about public statements with alleged threats against his daughters. Determining whether those allegations meet the statutory requirements will depend on the actual conduct and evidence, rather than simply whether the statements caused anxiety or damaged his reputation.

The temporary order directs Cabal to cease or avoid harassment, avoid Kennedy’s residence and premises temporarily occupied by him, and avoid contact that harasses or intimidates him. It also prohibits contacting him or causing another person to contact him without his written consent, except through an attorney or law enforcement officer.

The checked provisions do not expressly direct Cabal to delete her Facebook post or impose a blanket prohibition on public discussion of Kennedy. The order nevertheless places enforceable restrictions on her conduct while the case awaits a hearing.

There is also a discrepancy in the supplied paperwork concerning the expiration date. The photographed first page states November 9, while the hearing notice and public docket identify November 16, with the docket expressly stating that the temporary order remains effective until that date.

Kennedy was required to pay a $235 filing fee, according to the docket. Neither of the two provisions allowing the case to proceed without payment is checked on the photographed order.

Wisconsin’s court forms distinguish between qualifying allegations that permit a harassment case to proceed without a filing fee and a waiver based on inability to pay. Qualifying conduct can include stalking, specified physical harm, sexual assault, property damage, or threats of that conduct; an indigency waiver concerns the petitioner’s financial circumstances.

The practical result here is that Kennedy did not receive permission to proceed without paying, and the docket records his payment. The supplied documents do not establish that he submitted a separate indigency application that was denied, nor does payment itself establish that the petition is frivolous or that the alleged threats were disproved.

Cabal, who uses the names “Billy Violet” and “Billy LC,” publicly alleged that Kennedy provided financial assistance during her divorce and suggested sexual favors in return. She said she felt obligated to participate on multiple occasions and posted screenshots of messages she attributed to him.

One October 2024 message shows Cabal accusing the recipient of thinking he could “buy your way into my pants” and referring to $60. The contact labeled “Anthony” subsequently apologized for a “crass comment” and described it as “a lame attempt at humor.”

Another exchange includes the contact stating, “I had no plan,” and describing being “joyfully surprised about our interaction.” The screenshots do not expressly admit that financial assistance was conditioned on sexual activity, and KCE has not independently authenticated the complete conversation.

Kennedy did not respond to KCE’s earlier request for comment about Cabal’s allegations or the authenticity of the messages. His restraining-order petition now places his own allegations against Cabal into the court record, but the reviewed factual statement does not provide a detailed response to her account of their relationship.

Andrew Allen “Andy” Berg, 48, of Kenosha
(Kenosha County Sheriff’s Office)

Cabal said her decision to speak publicly followed KCE’s reporting about Kennedy’s email to Liberal Judge Jason Rossell (D) supporting longtime friend and fellow Democrat Andy “Sgt. Hard” Berg. Kennedy’s appeal described Berg’s potential for rehabilitation while his felony prosecution remained pending.

The November 16 hearing is the next scheduled opportunity to examine Kennedy’s harassment allegations in court. The central unanswered questions include what threats were allegedly made, what evidence supports them, and whether the conduct described meets the requirements for a longer-term injunction.
