KENOSHA, Wis. — A felony case accusing a Kenosha certified nursing assistant of physically abusing an elderly resident at a local care facility was dismissed with prejudice Tuesday after a judge ruled prosecutors failed to prove a required element of the charge.

Jahnix A. Medina, 28, was on trial this week on a charge of physical abuse of an elder person, a Class H felony, stemming from allegations that she intentionally caused bodily harm to a resident at Water’s Edge in April 2025. The jury trial began Monday, Jan. 20, and continued into Tuesday before Judge Jodi L. Meier.
According to court minutes from Tuesday, the State of Wisconsin, represented by Assistant District Attorney Patrick Gould, presented its case and rested after calling its final witness.

After the State rested, Medina’s defense attorney, Attorney Terry Rose, requested to make a motion outside the presence of the jury. Jurors were excused, and the defense moved to dismiss the case on the grounds that prosecutors had not presented evidence establishing that the alleged victim was 60 years of age or older — a required element of the charged offense.
Judge Meier agreed, finding that the State had failed to introduce evidence of the alleged victim’s age as it related to Count 1 of the information. The court ordered the case dismissed with prejudice, meaning the charge cannot be refiled.
With the dismissal, the jury was never asked to deliberate, and Medina was fully acquitted of the charge.
Medina had originally been charged last spring following an incident at Water’s Edge, where she worked as a CNA. Prosecutors alleged she pushed a resident during care, causing the resident to fall and suffer a head injury. Medina denied the allegations, and the case proceeded to a jury trial nearly nine months later before being dismissed.

If you read the article, it wasn’t the DA himself, it was one of the ADA’s that prosecuted the case! The DA can’t be everywhere!!

I just love how she wants a follow up story. The kenosha county eye did the right thing in being fair to report the outcome of the trial. That’s what we pay for, to read the news.
But this girl needs to know in the public eye, she is guilty as hell. And she will be looked upon as a person that beats elderly men and women in a nursing home. I wouldn’t be out there celebrating like you were found innocent. You just got lucky. For the rest of your life every time you look up and see that squad car behind you, you are going to sweat and think are they coming for me? Why? Because you are guilty and in Kenosha people don’t forget, no matter how much time goes by. We will always remember that you beat someone’s loved one in a nursing home. And in my eyes you are no better than someone who would hurt an innocent child.
We don’t know the outcome if this technicality wasn’t introduced. Maybe she was going to be innocent anyways.

So the Prosecution never entered the victims birth certificate ?
They failed to submit documents/evidence that this victim was over 60 ??
If that’s correct, how does this ADA still have a job ?
Or is the victim under 60 ?
All they needed was the BC or even one person to testify this gentleman was in his 70’s. For that matter, they could have used any of his medical records to show his birthdate. There are computer programs that can check to see if everything was filed and will be introduced regarding the charges. Did this ADA want her to get off? If they presented any records and on those records his official birthdate, the ADA should have tried to argue he had introduced proof.
I guess this one is a do over.

Please follow up with staff at this facility who know what happened. The elderly man didn’t fall on his own. I hope she’s no longer employed as a CNA. Our seniors deserve so much better.
Proving the victim’s age is literally an element of the crime. This is law school 101 stuff. What a gaffe….
Wow! Talk about loopholes! Now this monster can work at another home and harm other elderly residents. Seems like a real stupid technicality, especially since it was a NURSING home! And as an aside, the age should not matter–she was charged to care for patients not hurt them.
It is not a “loophole.” It is a clear element of proving the crime. Someone else said, and they are absolutely correct, Law School 101. The concept is also taught in many high school classes. They could have charged her with something else, but they chose to charge her with this crime.
One concerning issue with the DA’s office, specifically the ADAs, is their lack of preparation on cases. Laziness is found in every career field, even the well-educated ones.
They are likely going to refile for different charges. i would hold off on that retraction KM That place is a complete dump and i feel sorry for people who entrust care to these garbage people.
