Jury Picked In Jealous Ex-Boyfriend Murder Case – Opening Statements Tuesday

A jury has been seated in the murder trial of Zachariah Anderson. Anderson is accused of murdering his ex-girlfriend’s new boyfriend, Rosalio Gutierrez, Jr. According to the criminal complaint:

On May 19, 2020 at 11:07 am, Kenosha police were summoned to Gutierrez’s Wood Creek apartment by his girlfriend. He had not been seen or heard from since two days prior. She looked into the apartment and saw a missing rug and large amounts of blood. Detectives and evidence technicians arrived to process the crime scene. Police theorized that there was a struggle and someone was severely injured during a struggle. A large pool of blood was discovered on the floor, consistent with someone who lost a lot of blood over a period of time.

Gutierrez’s girlfriend told police about her ex boyfriend, and the father to her three children, Zachariah Anderson. Anderson was obsessed with Gutierrez and called him racial slurs. He had a file on his laptop and a map with Gutierrez’s address circled. There was evidence discovered that Anderson was stalking his ex-girlfriend with a GPS device he had purchased.

Police searched Anderson’s vehicle and found blood that came back with Gutierrez’s DNA. They also found visible bleach spots and missing rear seats, consistent with a cover-up.

Police went to Anderson’s Mequon, WI home and found a burn pit with a burnt bleach bottle, steel toe boots, and clothing. A cadaver dog alerted to the clothing.

A second burn pit was located on the Anderson family tree farm and a cadaver dog alerted to another area. More clothing was found burnt.

Anderson was on camera at a department store buying suspicious items like rubber gloves and garbage bags. He parked far away from the store.

In addition to first degree murder, Anderson is also being charged with two counts of stalking and one count of hiding a corpse.

For the State of Wisconsin, Kenosha County DA Mike Gravley is prosecuting this case. Although a controversial figure in Kenosha, no defense attorneys argue that he is anything but a highly successful trial prosecutor. He is being assisted by seasoned Assistant District Attorney Jessica Krejcarek. The amount of evidence in this case will make it an uphill battle for the defense team.

Appearing today for the defense were Attorneys John Birdsall, Kirk Obear, and Nicole Muller. Muller, however appears to be taking the lead after today. The three attorneys are very experienced and all work at Birdsall Obear & Associates in Milwaukee.

Presiding over the murder trial that is expected to take about two weeks, is America’s Judge, Bruce Schroeder. Of course, he played Jeopardy with the almost 100 potential jurors.

Kenosha Police Officer Jeffrey Van Wie, the department’s new criminalist took the stand today because of a defense motion to rule that he is not an expert on blood spatter. Graveley and Muller questioned the officer at length and Judge Schroeder will rule in the morning whether or not he meets the criteria to be called an expert.

Jurors are due back Tuesday morning at 9 am.

In the Kenosha County Courthouse today, there are two homicide trials, a sexaual assault trial, and a robbery/burglary/substantial battery trial. There is also a TPR (Termination of Parental Rights) court trial, which might be a record for Kenosha County.
