Teen Accused of Incest Held on $100K Bail After Allegations of Repeated Abuse

KENOSHA, Wis. – A 19-year-old Kenosha man is being held in jail on $100,000 cash bail after being charged with two counts of incest involving a close underage relative.

Justian C. Smith Jr. appeared in Kenosha County intake court Monday following his arrest on a felony warrant issued June 6. Court Commissioner William Michel II set bail at the same amount as the warrant. If convicted, Smith faces up to 80 years in prison—40 years for each Class C felony.

According to a criminal complaint filed by the Kenosha County District Attorney’s Office, the allegations stem from incidents that occurred between April and November of 2024 while both Smith and the teenage girl were living at their father’s home on Washington Road.

The alleged victim, who was 15 at the time, disclosed the abuse during a forensic interview conducted at Children’s Hospital in Milwaukee this spring. She reported multiple serious sexual assaults with Smith, which she said began shortly after she moved into the home.

The complaint indicates that the girl had not lived with her father or his family before April 2024. According to their father, this was her first extended stay with them, and she moved out again in November.

Detectives from the Kenosha Police Department conducted follow-up interviews with both the victim and Smith. According to the complaint, Smith admitted to certain incidents involving inappropriate behavior and confirmed that there had been a sexual relationship. While he attempted to shift blame, he ultimately acknowledged multiple encounters that matched parts of the victim’s account.

The exact nature of the relationship between Smith and the victim is being withheld to protect her privacy, but the complaint states they are closely related by blood and that the alleged conduct qualifies under Wisconsin’s incest statute, which prohibits sexual contact between close family members.

A preliminary hearing is scheduled for June 24.

Each count of incest is a Class C felony, punishable by up to 40 years in prison and a $100,000 fine. Smith remains in custody at the Kenosha County Jail pending further proceedings.

KENOSHA, Wis. — Residents with tree limbs, brush and other storm-related debris resulting from this week’s severe thunderstorms are encouraged to contact the City of Kenosha Department of Public Works to arrange for curbside collection.
