KENOSHA, Wis. — A 35-year-old Kenosha woman was charged in court Wednesday with misdemeanor operating while intoxicated (OWI) 3rd offense, but prosecutors say the charge will likely be upgraded to a felony if she’s convicted in a pending OWI case.
Ashley D. Lott was arrested on July 21 after allegedly crashing her black Chevy Impala into two parked vehicles on 34th Avenue and fleeing the scene. According to the criminal complaint, officers used a drone to locate her several blocks away. She initially denied driving, then admitted she was behind the wheel and alone in the vehicle.
In court Wednesday, Court Commissioner William Michel II ordered a $2,500 cash bail. A preliminary hearing is set for Aug. 1.
Although she is currently charged with misdemeanor OWI 3rd, state law allows prior convictions to count toward enhanced sentencing if they are entered before judgment in the new case. Lott is already facing a separate OWI 3rd charge filed earlier this year. If that case results in a conviction before this one is resolved, the new charge would automatically become a felony OWI 4th.
Lott is also charged with operating while revoked, failure to install an ignition interlock device, and five counts of misdemeanor bail jumping for allegedly violating bond conditions in multiple open cases.
The case is being prosecuted by the Kenosha County District Attorney’s Office. Lott remains in custody unless she posts bail.
