KENOSHA, Wis. — The Kenosha County District Attorney’s Office has not yet formally filed the sweeping drug and firearms charges against former County Board Supervisor and former Corrections Sergeant Andy “Sergeant Hard” Berg, but prosecutors laid out extensive allegations in court Tuesday as Berg appeared on a temporary bond hearing tied to a major Kenosha Drug Operations Group investigation.

District Attorney Xavier Solis personally appeared in court and delivered an oral probable cause statement, outlining the charges the state intends to file and asking the court to impose a $300,000 cash bail. Solis told the court investigators believe Berg operated a drug trafficking operation out of his Kenosha residence, repeatedly selling controlled substances and illegally transferring firearms to a prohibited person.
According to Solis, detectives conducted multiple controlled purchases in which Berg allegedly sold marijuana, psilocybin mushrooms, and GHB — a powerful sedative commonly referred to as a date rape drug. Solis said one transaction involved the sale of two firearms and a large quantity of GHB to an individual Berg allegedly knew was a convicted felon. Investigators later executed a search warrant at Berg’s home and allegedly recovered methamphetamine, THC, GHB, drug packaging materials, ledgers, and multiple firearms.
Solis told the court investigators believe Berg’s residence functioned as a drug trafficking house and that drugs and firearms were accessible while an 11-year-old child was present in the home. Prosecutors asked the court to impose strict no-contact conditions with the residence, the child, and Berg’s girlfriend, who is expected to be charged as a co-defendant.
Despite the state’s request for a $300,000 cash bail, Court Commissioner William Michel II ordered only a $75,000 cash bail, along with conditions prohibiting drug use, weapon possession, and contact with witnesses and co-defendants. It remains unclear whether the unusually low bail was ordered solely by Michel or influenced in any way by Judge Chad Kerkman, Berg’s longtime friend. Both Michel and Kerkman have reputations for being soft on crime.
Kenosha County Eye observed Berg throughout the hearing and noted that he remained silent and kept his head down for most of the proceedings.
Kerkman, who serves as deputy chief judge — a largely honorary title that does not confer any additional legal authority but which he is widely viewed as wielding as if it does — has not said whether he will recuse himself from any involvement in Berg’s case. As of publication, Kerkman has not responded to questions about whether he will step aside despite his close personal and financial ties to Berg.
In a separate but related development, Berg was recently charged with felony theft of more than $2,500 in an unrelated case. He has not yet appeared in court on that charge.
Berg is scheduled to be formally charged in the KDOG case on Wednesday at 1 p.m. and remains in custody pending the posting of bail.

$75K bail is not insignificant.
It is low, considering the charges/criminal enhancers of selling drugs & fire arms close to a school/his prior record, and the fact that he only needs to post 10% of that to be released. That’s the reason why he’s labeled a soft-on-crime judge.
