KENOSHA, Wis. — Former County Board Supervisor and former Corrections Sergeant Andy “Sergeant Hard” Berg was formally charged Tuesday in a sprawling drug and firearms case following a months-long Kenosha Drug Operations Group investigation, with bail set at just $75,000 cash despite prosecutors previously seeking a far higher amount.

Berg’s charging hearing came two days after prosecutors laid out detailed allegations during a probable cause hearing on Monday. On Wednesday District Attorney Xavier Solis appeared in court as the amended criminal complaint was filed, officially charging Berg with 16 counts that include multiple felony drug delivery charges, straw purchasing firearms for a felon, maintaining a drug trafficking place, and neglecting a child.
At Monday’s hearing, Solis asked the court to impose a $300,000 cash bail, citing what prosecutors described as an extensive drug operation, repeated controlled buys involving multiple controlled substances, and the presence of firearms inside a home where an 11-year-old child was living. On Tuesday, Court Commissioner William Michel II left bail unchanged at $75,000 cash. His father posted bail around 5:33 p.m. and Berg was released back into the community.
It remains unclear whether the relatively low bail was ordered solely by Michel or whether Judge Chad Kerkman, Berg’s longtime friend, had any role or influence. Both Michel and Kerkman have reputations for being soft on crime. Kerkman serves as deputy chief judge — a largely honorary title that does not confer any additional legal authority, but one he is widely viewed as wielding as if it does. Kerkman has not said whether he will recuse himself from any involvement in Berg’s case, and as of publication, he has not responded to questions about whether he will step aside despite his close personal and financial ties to Berg.

Kenosha County Eye was present in court Tuesday and observed Berg remain silent throughout the proceedings, keeping his head down as the court addressed the charges and scheduling. Berg appeared with Assistant Public Defender Benjamin Schwarz.
According to the amended criminal complaint, investigators allege Berg sold marijuana, psilocybin mushrooms, GHB, hydrocodone, and methamphetamine during multiple controlled buys conducted between October and December. In one transaction, Berg is accused of selling two handguns to a person he knew was a convicted felon, a charge prosecutors have emphasized as particularly serious.
A search warrant executed at Berg’s Kenosha residence allegedly uncovered large quantities of controlled substances, drug packaging materials, ledgers believed to document drug sales, nitrous oxide canisters, and multiple firearms. Investigators also allege drugs and firearms were accessible inside the home while Berg’s 11-year-old child was present, forming the basis for the child neglect charge.
The case represents the latest and most serious chapter in Berg’s long public downfall. Once an elected county supervisor and corrections sergeant, Berg has spent years mired in controversy, including his termination from the Department of Corrections, public records litigation, financial disputes, and revelations that he operated as an amateur pornographic content creator under the name “Sergeant Hard.” Berg was also involved in Garden of Eatin, a now-defunct nonprofit that later became the subject of theft allegations.
In a separate but related development, Berg was recently charged in another case with felony theft of more than $2,500. That case was dismissed, but prosecutors have stated the charge will be refiled. Berg has not yet appeared in court on that matter.
Berg is due back in court on December 26 for a preliminary hearing in the drug and firearms case. Kenosha County Eye has been informed that arrangements are already underway for someone to post Berg’s bail.

Berg’s girlfriend and alleged co-defendant, Laura Mercado, was also in court Tuesday. Despite having significantly less criminal exposure than Berg, Mercado was likewise given a $75,000 cash bail. Prosecutors have charged her with multiple felony drug offenses tied to the same investigation. Her case will proceed separately, though it stems from the same KDOG operation.

Mr. Mathewson, There’s no doubt the bond amount was set that low to send one more intimidating message to Eye. Jerkman doesn’t want you writing anymore, and he and his allies seem to be reaching too far. Michel doesn’t have the independence to set bond in a case like this without first asking his master.
