The family of a deceased little girl named Zha’riyah Robinson tell KCE the mother of the man on trial for raping her, Lindsay Schroeder, smiled at them as she left the courtroom today, starting a disturbance at about 9:40 am. Dozens of police officers and Sheriff’s Deputies poured onto 56th st in front of the courthouse.

KCE spoke to two of Zha’riyah’s aunts, her mother, her grandmother and her grandfather. They were very upset leaving today’s court hearing for several reasons. First, they say, the Assistant District Attorney on the case, Alexandra Smathers, refuses to ask for a cash bail for the accused rapist, Dakari Childress, saying that there is no basis. KCE contacted Smathers, but she did not respond.

This incident followed a court hearing in which new dates were set in the prosecution of the State of Wisconsin vs Dakari Childress. Only one woman was cited – Zha’riyah’s 22-year-old aunt, named Xazire. She was cited for Disorderly Conduct and she said it was because she used profanity, but that she is still grieving the loss of her niece and didn’t think the $313 citation was fair. She plans to fight the ticket in municipal court.

Zha’riyah was brutally sexually assaulted on August 22, 2023, and unfortunately, passed away less than three months later on November 16, 2023 in Surprise, Arizona. What we don’t know is how she died. In court several weeks ago, ADA Smathers called Zha’riyah’s death “suspicious.”

A highly skilled sexual assault nurse who spoke with KCE said that the death could be linked to her rape, which was oral, vaginal, and rectal. A rectal tear could cause a slow and terrible death under certain circumstances.

According to the criminal complaint, 15-year-old Dakari S.D. Childress was briefly watching Zha’riyah at a home in Kenosha. He was then alleged to have brutally raped her in every possible way. Zha’riyah was able to depict to Kenosha Police exactly what happened.

Childress was charged as a juvenile at first, but Judge Meier sent him to be tried as an adult. He made his initial appearance as an adult on February 7, 2024. The Kenosha DA’s office asked for a $25,000 cash bail. Commissioner Michel ordered a no-cash bail, meaning that Childress was released into the public without having to pay any money. This angered Zha’riyah’s family.

“[No cash bail] is never fair in this world,” said Timothy Stark, Zha’riyah’s grandfather. “I’m demanding the Kenosha DA’s office ask for a million dollars cash bail.”

Lt. Joshua Hecker, Kenosha Police

“We handled a sexual assault case with Childress as a suspect. After our conversation, I spoke with a couple [of] detectives and found that Surprise PD in Arizona is investigating the child’s death,” said KPD Spokesman Lt. Josh Hecker.

KCE reached out to the Surprise, AZ police department. Sgt. Rick Hernandez released the following statement:

“This investigation is still open and is pending the full medical examiner’s report.  Here is a summary of the SPD investigation to date.

On 11/16/2023, Officers responded to a local urgent care after Zha’riyah became unresponsive.  Upon arrival, Officers observed medical staff attempting life-saving measures.  Zha’riyah was transported to a local hospital in critical condition, where she later passed away.  Detectives from the Surprise Police Department responded, interviewed her guardian, medical staff, and executed a search warrant of Zha’riyah‘s residence.  On 11/18/2023 an autopsy was conducted.  While the full medical examiner’s report is not complete, the medical examiner did not find any obvious signs of new trauma.

Throughout this investigation, Surprise PD investigators have been in contact with Kenosha PD regarding Zha’riyah’s past family history.”

Today in court, Childress’ attorney asked for more time for trial to await DNA results. Childress is still out on a no-cash bail.

Childress is also out on felony bail in Winnebago County for stealing a gun from a pawn shop.

Kenosha County Circuit Court Judge Anthony Milisauskas could have raised Childress’ bail on his own motion, (Sua Sponte), but it is unusual. In most cases the prosecutor makes a motion to increase bail. In this case, it is unknown why the Kenosha DA’s office is OK with the no-cash bail for this allegedly dangerous man, who Zha’riyah’s family tells KCE, is living in a group home.

        1. I hope they put his ass under Tha prison I’m so sorry your family is going through this!!!!! He is sick and doesn’t deserve to be out!

  1. EVERYONE take note – who’s in the right and who’s in the wrong.

Judge Meier tried to do what’s right. Michel, Smathers – dropped the ball. 16 years old or not, this could should NOT be in society. He needs a high sky bail and to be locked up so he can be tried as an adult.

    29
    3
    1. The purpose of bail is to ensure defendants return to court, not to keep them incarcerated before they’ve had a fair trial. 16 year olds aren’t flight risks.

      2
      14
        1. Someone who is out on bail is just as much as a risk as someone who wasn’t given bail at all. The difference is wealth. The system shouldn’t work differently for rich people.

          1
          1
      1. He is clearly a flight risk.. he just got charged with another felony for stealing a fire arm. Are you kidding?! What would he have done with that gun, ya think? Keep it for protection? Get outta here

        12
        1
        1. Flight risk means skipping out on his court dates and attempting to flee from justice. Where is a 16 going to go, exactly?

Bail isn’t the solution to this issue. The ADA didn’t do anything wrong here (despite plenty of other immoral practices)

            1. By that logic, no one should ever be released on bail. Hey, why not skip the trial too?

This type of reasoning is incredibly short-sighted. This isn’t the olden days where criminals can skip town and take a new name. Pre-trial detention for anyone charged with a serious crime would be a constitutional crisis. The DA didn’t err here by not assigning cash bail.

  2. I feel so sorry for that baby girl and what she suffered. He looks like he did whatever they say he did! Who else would have done such sick thing? Pray you guys get justice and FAST

  3. What everyone is getting is wrong information from the little girls family. Anyone ever question and put down her mother for not having her own child. Why was her child not with her for several months? Why are we not posting and questioning the suppose to be friend that this little girl was with. The mother didn’t know what was going on with her own child because she did not have custody. Come people. Know the facts before accusing some one of some thing.

    10
    7
    1. she did have custody it temp arrarngment while she get on her feet. she never got her took i been following both pages along time the lady was lying to mom and sayingbthe girl ohone was dead or broken this laday played like this women child wasnt dead for some months

      2
      1
      1. I been also following! What this lady did is horrible. It’s still a on going investigation. So why isn’t her name all in the papers for possible homicide, abuse etc.? She was responsible for this little girl and look what happened. She didn’t tell the mother for months, why not?? There’s plenty more behind this!

      2. What about when the mother left her little girl with a complete stranger for 3 weeks around New years just because she wanted to party and then never picked up the little girl her mom didn’t care about her. I think the godmother has something to do with her death in Arizona and that’s why she had her cremated and is hiding what really happened and why the child really died. And let’s be for real the godmother told the mom a long time ago that the little girl told her that someone was touching her on her mother’s side of the family. I think the mom and the godmother did something to the little girl and the mother knew the whole time that she was dead but just now saying that she just found out because she doesn’t want to be accused of killing her own child.

        1. No one touch her n the mom family jinquisha delusional ass made that shit after she allowed it to happen to her cuz she didn’t want her to go tell her mother that’s y when she asked for her child she made up that story but no one n the mom family was investigative for an assault so get yo facts straight before saying some shit n if u read they asked the child has anyone else ever touch u she replied no only him I’m pretty sure if other was touching they would be getting charge also

        2. She has other kids idiot why tf would she just k!ll one if that’s the case? And not all of them? And the messages between them says otherwise .

    2. That doesn’t change the facts that the boy raped the Lil girl and caused her death it doesn’t matter if her mom didn’t have her child she asked the child’s God mother to keep her until she got in a home stop putting blame on everyone except the actual person who did this to her!!!!!

      10
      1. Really both these woman failed her. Y your so quick to say this boy guilty what about her God ma that had her. That’s a GREAT god ma if that’s what you want to call her after she got placement from the courts then left with her and didn’t inform her actually mother of ANYTHING. Come on. Wrap your brain around all this. Seriously none of this adds up. People be real.

        2
        0
    3. Facts still remains she died in the hands of jinquisha it doesn’t who had custody or why this lil baby is still gone n there are questions that needs to answer

  4. I’m shocked they didn’t claim maga country and charge Trump with a crime. Justice system……? Haaaaaaaaaaaaaaaaaaaaaaaaaa!

    3
    3
  5. I’m actually cool with no bail. Ideally, someone will take this fucker out before he ever reaches trial.

    9
    1
  6. This mother didn’t have her child. So you know why she was NOT NOTIFIED this accusation. She claims she gave temporary placement to the woman she once called her friend because she was waiting on housing. FYI you cannot get housing for children you DO NOT NOT HAVE!!! This woman had her child for MONTHS!!! This is why she was not notified about her child supposedly being abused or that she passed away. This young girl claimed she was being abused when she was with her mom. The woman who was suppose to protect her didn’t! Then the mother’s friend was suppose to protect her and obviously didn’t and that’s still being investigated the cause of her death. The young man who is being accused of this didn’t have the opportunity nor time to commit the crime he’s being accused off. This little girls mother shouldn’t have any of her kids. You are innocent until proven guilty.

    2
    4
  7. This child rapist learned it from somewhere. Find and arrest those rapists too. Many group homes and foster homes are not safe places. The man deserves what he gets but I also want to see the people that taught him the horrific crimes to rot in hell too.
