One Cited After Courthouse Disturbance Involving Deceased 5-Year-Old

The family of a deceased little girl named Zha’riyah Robinson tell KCE the mother of the man on trial for raping her, Lindsay Schroeder, smiled at them as she left the courtroom today, starting a disturbance at about 9:40 am. Dozens of police officers and Sheriff’s Deputies poured onto 56th st in front of the courthouse.

KCE spoke to two of Zha’riyah’s aunts, her mother, her grandmother and her grandfather. They were very upset leaving today’s court hearing for several reasons. First, they say, the Assistant District Attorney on the case, Alexandra Smathers, refuses to ask for a cash bail for the accused rapist, Dakari Childress, saying that there is no basis. KCE contacted Smathers, but she did not respond.

This incident followed a court hearing in which new dates were set in the prosecution of the State of Wisconsin vs Dakari Childress. Only one woman was cited – Zha’riyah’s 22-year-old aunt, named Xazire. She was cited for Disorderly Conduct and she said it was because she used profanity, but that she is still grieving the loss of her niece and didn’t think the $313 citation was fair. She plans to fight the ticket in municipal court.

Zha’riyah was brutally sexually assaulted on August 22, 2023, and unfortunately, passed away less than three months later on November 16, 2023 in Surprise, Arizona. What we don’t know is how she died. In court several weeks ago, ADA Smathers called Zha’riyah’s death “suspicious.”

A highly skilled sexual assault nurse who spoke with KCE said that the death could be linked to her rape, which was oral, vaginal, and rectal. A rectal tear could cause a slow and terrible death under certain circumstances.

According to the criminal complaint, 15-year-old Dakari S.D. Childress was briefly watching Zha’riyah at a home in Kenosha. He was then alleged to have brutally raped her in every possible way. Zha’riyah was able to depict to Kenosha Police exactly what happened.

Childress was charged as a juvenile at first, but Judge Meier sent him to be tried as an adult. He made his initial appearance as an adult on February 7, 2024. The Kenosha DA’s office asked for a $25,000 cash bail. Commissioner Michel ordered a no-cash bail, meaning that Childress was released into the public without having to pay any money. This angered Zha’riyah’s family.

“[No cash bail] is never fair in this world,” said Timothy Stark, Zha’riyah’s grandfather. “I’m demanding the Kenosha DA’s office ask for a million dollars cash bail.”

“We handled a sexual assault case with Childress as a suspect. After our conversation, I spoke with a couple [of] detectives and found that Surprise PD in Arizona is investigating the child’s death,” said KPD Spokesman Lt. Josh Hecker.

KCE reached out to the Surprise, AZ police department. Sgt. Rick Hernandez released the following statement:

“This investigation is still open and is pending the full medical examiner’s report.  Here is a summary of the SPD investigation to date.

On 11/16/2023, Officers responded to a local urgent care after Zha’riyah became unresponsive.  Upon arrival, Officers observed medical staff attempting life-saving measures.  Zha’riyah was transported to a local hospital in critical condition, where she later passed away.  Detectives from the Surprise Police Department responded, interviewed her guardian, medical staff, and executed a search warrant of Zha’riyah‘s residence.  On 11/18/2023 an autopsy was conducted.  While the full medical examiner’s report is not complete, the medical examiner did not find any obvious signs of new trauma.

Throughout this investigation, Surprise PD investigators have been in contact with Kenosha PD regarding Zha’riyah’s past family history.”

Today in court, Childress’ attorney asked for more time for trial to await DNA results. Childress is still out on a no-cash bail.

Childress is also out on felony bail in Winnebago County for stealing a gun from a pawn shop.

Kenosha County Circuit Court Judge Anthony Milisauskas could have raised Childress’ bail on his own motion, (Sua Sponte), but it is unusual. In most cases the prosecutor makes a motion to increase bail. In this case, it is unknown why the Kenosha DA’s office is OK with the no-cash bail for this allegedly dangerous man, who Zha’riyah’s family tells KCE, is living in a group home.

    Judge Meier tried to do what’s right. Michel, Smathers – dropped the ball. 16 years old or not, this could should NOT be in society. He needs a high sky bail and to be locked up so he can be tried as an adult.

          Bail isn’t the solution to this issue. The ADA didn’t do anything wrong here (despite plenty of other immoral practices)

              This type of reasoning is incredibly short-sighted. This isn’t the olden days where criminals can skip town and take a new name. Pre-trial detention for anyone charged with a serious crime would be a constitutional crisis. The DA didn’t err here by not assigning cash bail.

Why was her child not with her for several months? Why are we not posting and questioning the suppose to be friend that this little girl was with. She claims she gave temporary placement to the woman she once called her friend because she was waiting on housing. FYI you cannot get housing for children you DO NOT NOT HAVE!!! This woman had her child for MONTHS!!! This is why she was not notified about her child supposedly being abused or that she passed away. This young girl claimed she was being abused when she was with her mom. The woman who was suppose to protect her didn’t! Then the mother’s friend was suppose to protect her and obviously didn’t and that’s still being investigated the cause of her death. The young man who is being accused of this didn’t have the opportunity nor time to commit the crime he’s being accused off. This little girls mother shouldn’t have any of her kids.
