KENOSHA, Wis. — A Bradford High School teacher was arrested Thursday night on multiple misdemeanor charges including domestic violence–related battery, disorderly conduct, and two counts of resisting or obstructing an officer.

Why wouldn’t she still be on the job? She’s been arrested, not convicted, and it didn’t take place in a school. As much as Kenosha has been plagued with employees that never should have been hired and definitely shouldn’t have been kept, I don’t see a situation here where I could see firing her would not immediately bring lawsuits that we as taxpayers would end up paying. No, I’ve never met her and do not know her.

Employers are significantly restricted under the Wisconsin Fair Employment Act (WFEA) in how they may use an individual’s “arrest record” to make an employment decision. The WFEA defines “arrest record” expansively as: “information indicating that an individual has been questioned, apprehended, taken into custody or detention, held for investigation, arrested, charged with, indicted or tried for any felony, misdemeanor or other offense pursuant to any law enforcement or military authority.”
Employers are still permitted to refuse employment or to terminate an employee who was arrested for an offense if the employer conducted its own independent investigation of the circumstances of the arrest and if the employer is genuinely satisfied as a result of that investigation that the employee committed the act for which they were arrested and that such an act violates the employer’s policies or expectations. The key factor for this exception to apply is that the investigation must be truly independent and cannot merely rely upon a police report or an arresting officer’s assurance that the individual will be found guilty. At a minimum, an employer would need to interview the employee or other witnesses to determine whether the misconduct occurred. potential criminal matters, which informs employees of their duty to cooperate with their employer’s investigation but that the information provided to the employer cannot be shared with law enforcement.

As her former student she is a very sweet individual who has been a shoulder to cry on, an ear hear to listen, and a healer. You don’t find many comfort teachers that one just love their job but love their kids even harder as if they are their own. I don’t know why you would think she would be fired? The situation didn’t involve a student there. But she’s not another fallen staff member on the list.
