“Upskirting” Defendant Arrested Again, Child Pornography, Drugs Found

A 40-year-old Kenosha man, free on a $15,000 cash bail for taking videos of women and young girls up their skirts, was re-arrested yesterday. Kevin A. Pursell was arrested after Kenosha Police found child porn and nearly a pound of THC in his home. Today, Pursell was charged with nine counts of felony Possession of Child Pornography, felony Possession of THC With Intent To Deliver, Felony Capturing An Intimate Representation Without consent, and misdemeanor Invasion of Privacy. If convicted, He faces over 225 years in prison if convicted of only the new charges.

On Saturday, June 22, 2024, at approximately 11:00 AM, Kenosha Police Department Officer Brittni Bray was assisting with an investigation into defendant Kevin A. Pursell, who was an invasion of privacy – upskirting suspect.

Officer Bray reports that she observed KPD Officer Shaun Morton viewing footage from the camera Pursell had used that day at the Kenosha Harbor Market located near the Kenosha Museums. [See pending case Kenosha County Case Number 24CF940]. Officer Morton reports that over 100 videos that appeared to be “spy camera” type videos were also found on Pursell’s cellphone. Officer Morton reports that most of the videos that appeared to have been produced by Pursell were from inside what looked like a gym or inside stores.

Officer Bray reported that in addition to the woman Pursell used the camera on as detailed in Kenosha County Case Number 24CF940, Officer Bray observed in the above-mentioned camera footage that Pursell had targeted a F/W on June 22, 2024, at the Kenosha Harbor Market who appeared to be approximately 14 years of age. The female was wearing red loose-fitting cotton shorts. Pursell’s camera was angled in a direction that allowed it to capture a shot from under the female’s shorts where her buttocks were visible in the footage. Officer Bray reports that as Pursell’s camera continued to roll, it captured Pursell’s face and he was wearing the same gray t-shirt and black sunglasses that he was wearing during Officer Bray’s initial contact with him that day.

Based on the information obtained during the investigation into 24CF940 and the further footage observed from Pursell’s above-mentioned camera, on Saturday, June 22, 2024, at approximately 4:50 PM, Kenosha Police Department Detectives and Officers executed a search warrant on the residence of Pursell which is located at 7945 24th Avenue in the City and County.

Det. Michael Gacke reports that during the search he located a substance that appeared to be consistent with marijuana in a jar in the basement. Det. Sergio Martini reports that the suspected marijuana was fresh marijuana and weighed 12 ounces. Officer Bray reports that she used a Duquenois-Levin Reagent System E test kit to test a piece of this suspected marijuana and received a positive result for THC (tetrahydrocannabinol).

Officer Bray reports that next to the jarred marijuana were located a black pipe with burnt marijuana residue and a multi-colored bong containing marijuana residue. Officer Bray reports that a silver metal grinder with remnants of marijuana leaves was located.

Det. Gacke also located 4 packages of flavored THC edibles/gummies in a bedroom within the residence. Officer Bray reports that the packaging for the edibles/gummies all indicated that they contain THC extract with one having 45 grams, one having 2 grams, one having 42.5 grams and the other having 7.2 ounces.

Det. Martini reports that 10 THC vape cartridges containing a gold liquid were also located with a total weight of 10 grams. Officer Bray reports that she read the labels on the THC vapes and the labels said that the product contains THC with each cartridge holding 1 gram of THC extract. Officer Bray reports that also located were two chocolate bars in cardboard packaging that stated that there was THC extract in the bars with 54 grams of THC extract being in each bar for a total of 108 grams of THC.

Totaling the above-mentioned grams and ounces [ounce to gram converter used] of THC, the total approximate weight of the total THC recovered on June 22, 2024, is approximately 751.5 grams. Your complainant spoke with KPD Det. Pablo Torres who has worked with the drug unit for some time regarding the amount of THC in this case. Det. Torres states that 751 grams equates to 28 ounces which is over a pound and a half of marijuana and so, he believes this amount to be possession with intent to deliver.

Det. Martini reports that 2 grams of mushroom pills were also located. Officer Bray reports that there were 3 pills pink in color and they had the label “Pinkies Magical Mushroom Pills” on them. [As of the date of the drafting of this complaint, no testing was completed on these pills.]

K9 Kala and K9 Iris

K9 Kala from Mt. Pleasant PD and K9 Iris from Kenosha Police were on the scene of the search to aid in locating hidden storage devices according to an Instagram post. Due to finding some storage devices in unusual locations, the K9s were called upon for a second search warrant and the dogs located a thumb drive and five micro sd cards that were hidden in conspicuous areas of the home. Micro SD cards are 15mm by 11mm by 1mm, roughly the size of an adult fingernail. Iris and Kala have the same trainer and work very well together as a team according to Kenosha Police Detective Pete Deates. According to the IG post:

“Lucy and Ethel Aka @_k9iris and @e sd_k9_kala were at it again in @_k9iris #hometown!! This time they had a special request to come out and search a #badguy’s residence for some hidden devices!! These #hardworkinghounds NAILED it!!! So proud of #ourgirls 🐕‍🦺🦮”

Det. Gacke reports that during the search, he further located a bag that had what appeared to be tiny cameras concealed in the corner of the bag that were not noticeable from the outside of the bag. Det. Gacke reports that this appeared to be a homemade device used to record without someone noticing.

Officer Javier Vega reports that different brands of CD-Rs were located in front of the back east bedroom closet, more CD-Rs were located in a drawer, and 5 mini-SD cards were located in a drawer. Officer Vega reports that a black flash drive, a white memory card, and a blue flash drive were also located in the bedroom. Officer Vega reports that a black memory card was located in the west bedroom on a TV stand.

Officer Bray reports that in a brown ottoman in Pursell’s living room she located 5 black and red “San Disk” USBs; a black “Garmin” dash cam; an older model silver Samsung cellphone; a blue “Fuji” USB; a green and silver USB; a black “POP” USB; two black USBs; one black “San Disk” SD card; a black “Dell” SD card adapter; a metallic colored G7-LG cellphone with black case; and assorted pieces of paper with log in information to various accounts. Officer Bray reports that on the TV stand in the living room she located a black “PNY” 4GM micro SD card and a black USB. Officer Bray reports that in the northeast side bedroom she searched a brown dresser and desk and she found a black Samsung Galaxy S6 cellphone; a white Samsung Galaxy S3 cellphone; a blue LG V60 cellphone; a black LG cellphone; a blue Toshiba hard drive with a yellow post it note with log in info; a black 32 GB “San Disk” micro SD card; a “Tasco” trail camera; a red and black “San Disk” SD card adapter; a blue “PNY” 1.0 GB SD card; and an orange and white 64 GB micro SD card.

Officer Megan Hird reports that these other items were taken from Pursell’s residence during the search warrant execution: a silver HP laptop with charger; a silver Dell laptop with charger; and miscellaneous CD/DVDs; a “Zetronix” self-installed ATOM hidden camera kit; a black square shaped camera; blue LL Bean bag with electronic equipment attached inside; “spy shoes” paper type note; etc.

One of the other items taken during the above-mentioned search of Pursell’s residence was a Dell Latitude E7440 computer. Det. Tommar Franklin reports that on June 27, 2024, KPD Forensics Officer Rusten Sheskey informed him that he had conducted an initial review of this particular laptop and he tagged 284 videos/photos as possibly containing child pornography and 3860 videos/photos categorized as child exploitative or age difficult.

Officer Sheskey further advised that he also located approximately 302 videos that appear to have been created by Pursell with the intent of filming people without their knowledge. Officer Sheskey advised that in a large number of the videos, Pursell records his face in the beginning or end of the recordings. Officer Sheskey tagged these vides as “Invasion of Privacy Media”.

Det. Franklin reports that KPD Sensitive Crimes ICAC Det. Peter Deates reviewed some of the suspected child pornography obtained from Pursell’s above-mentioned laptop. At the time of the drafting of this complaint, Det. Deates provided Det. Franklin with descriptions for 9 files which Det. Deates believes constitute child pornography.

Det. Deates reports that based on his training and experience, all of the images which he has described below constitute child pornography.

Det. Deates has previously described “pubescent” to mean a child who has begun to develop and display mature body shape and genital organs, consistent with what is seen in children ages 11-16 and “prepubescent” to mean a child who does not exhibit any, or very limited, physical-sexual development and the child appears to be well under the age of 18 and likely under the age of 13.

  3. This is a colored photo of an early pubescent aged female. She is completely naked and has her legs spread-eagle with her knees behind her elbows. Her fingers on both of her hands are spreading her labia open to expose her vagina to the camera.
  4. This is a colored photo of an early pubescent aged female. She is completely naked and her legs are spread-eagle to the camera. Her vagina and breasts are exposed. Her vagina is the focal point of the photo.
  5. This is a colored photo of an early pubescent aged female. She is completely naked and her legs are spread-eagle to the camera. She has both of her hands on each side of her vagina. Her breasts and vagina are exposed to the camera and are the focal point of the photo.
  6. This is a colored photo of a prepubescent aged male and a pubescent to adult aged female. They are both completely naked and are standing on what appears to be a bed. There are posters on the wall behind them and an American flag on the ceiling above then. The prepubescent male is on the right side of the female as you look at the photo. His right arm is wrapped around her side and his mouth is on her left nipple.
  7. This is a colored photo of what appears to be a pubescent to adult female who is standing next to a prepubescent aged male. He is in what appears to be his bed with Batman sheets. He is sitting up and his left arm is placed on her right breast.
  8. This is a colored photo of a toddler to prepubescent aged female. She has no clothing on her lower half and is wearing some type of blue top. Her vagina is exposed and is the focal point of the photo.
  9. This is a colored photo of an early pubescent aged female. She is completely naked. She is lying on the floor on top of some blankets or sheets. Her legs are spread apart exposing her vagina shown in the photo. Her breasts are also exposed in the photo.
