Kenosha Unified to Vote on “Safe School” Resolution Tonight Amid Immigration Enforcement Concerns

Kenosha, Wis. — The Kenosha Unified School District Board of Education is set to vote tonight on a resolution that would formally declare non-public areas of KUSD schools as “safe spaces” for students and families fearful of immigration enforcement actions.

The proposed measure comes in response to ongoing concerns from parents and community groups about the potential for U.S. Immigration and Customs Enforcement (ICE) agents or cooperating law enforcement to enter school grounds in search of non-citizens. Under the resolution, unless a valid judicial warrant is presented, the district would protest such enforcement efforts “to the fullest extent permitted by the law.”

The resolution points to the landmark 1982 U.S. Supreme Court decision in Plyler v. Doe, which held that public schools cannot deny children access to education based on immigration status, emphasizing the harm it would cause both to the children and society at large. It also cites KUSD’s existing Board Policy 5110.1, which prohibits discrimination based on national origin, immigration status, or other protected characteristics.

“There is no written state or federal law mandating that any school district assist in the enforcement of immigration laws,” the resolution states, reinforcing the district’s stance that educational settings must not be disrupted by immigration enforcement actions.

If adopted, the resolution would compel the Superintendent to take several specific steps:

  • Follow current procedures to ensure students have emergency care or child services support if their parents or guardians are detained by immigration authorities.
  • Develop internal guidelines within 30 days for school staff to follow if ICE or other cooperating law enforcement arrives unannounced.
  • Collaborate over the next 90 days with organizations including the League of United Latin American Citizens (LULAC) Councils 320 and 339, Forward Latino, legal service providers, and social services to provide resources and support to affected students and families.

District leaders noted that parents and students have increasingly expressed “fear and confusion” about sending children to school due to concerns over immigration enforcement activities. They also stressed that bullying or discrimination based on immigration status harms students’ feelings of safety, belonging, and academic success.

The schools are public schools, so how are they defining “public” spaces? Also, the high schools have school resource officers (SRO’s) which are KPD employees and not employed by KUSD.
    Is the cafeteria, commons, gym outside sports fields “public”. How will staff be protected from any possible litigation when found harboring an illegal immigrant? I don’t believe school policies supercede Federal mandates?

    First, as a taxpayer, I ask exactly what constitutes a non-public area within KUSD that these people think should be off limits to Law Enforcement or taxpayers? The School Board and Jeffrey Weiss do not own KUSD property. Under no circumstance should a penny of our tax dollars go towards sanctioned evasion of Federal Immigration Law and Enforcement.

    Second, if the School Board and upper Administration intend to follow through on this, I would expect Jeffrey Weiss, the Seven Members of the School Board, and any Senior member of KUSD Leadership supporting this to PERSONALLY stand in the doorway and make themselves subject to appropriate arrest and consequences. Don’t be cowards and make some Asst. Principal take the fall for your lawlessness. The people who REALLY care about the kids of Kenosha would love to see each of you perp walked in orange jumpsuits.

    Third, in truth, the people of Kenosha have only themselves to blame for this. You just put the retarded Rebecca Stevens, and the pervert Carl Bryan back on the School Board over two highly qualified, serious, and high character candidates who would be working on fixing the KUSD….rather than fulfilling some childish Marxist fantasies toward creating policy to degrade our culture.

The immigration act is very clear on this. It appears that the KSD board are putting their liberal necks on the line here. If the board members via their vote is giving tasid permission to the schools and employees under directive to commit a felonious act , therefore making the teacher, teacher aid or whomever the lighting rod for possible federal charges that will come of it. It also paves the way for the DOJ via the Department of Education to cut funding to the school district for violating federal mandates.

Truly if the members of the KSD board want to act in a manner that is unlawful they are doing so at their own peril. Or better yet move 6 miles south to the Peoples Republic of Illinois and be welcomed by Comrade Pritzker and his socialist followers.
