SOMERS, Wis. — A 44-year-old Bristol man who crashed his car while allegedly intoxicated and later threatened to kill two deputies has served his sentence almost exactly one year after the incident.
Duane T. Nicholas was initially charged on Sept. 24, 2024, with felony threat to a law enforcement officer, disorderly conduct, and possession of drug paraphernalia. The charges stemmed from a crash the night before in Somers, where Nicholas drove across the median into oncoming traffic and slammed into a tree in front of a Dunkin’ Donuts.
According to the criminal complaint, multiple witnesses told deputies that Nicholas had been driving erratically and nearly struck other vehicles before crashing. When deputies arrived, they noted that Nicholas appeared intoxicated—his speech was slurred, his eyes were bloodshot, and he smelled of alcohol. He wore a shirt emblazoned with the words “Crooks, Kush, Original High Society” and a marijuana leaf.
Nicholas admitted to drinking Tito’s vodka and blew a 0.145 on a preliminary breath test. He also acknowledged that there was marijuana and drug paraphernalia inside the car. Deputies found a butterfly-decorated bong and a striped glass pipe, which tested positive for marijuana residue.
While being transported to jail, Nicholas threatened to kill Deputies Daneil Denka and Tyler Brady, telling them he wouldn’t forget their faces. He then urinated in the back of the squad car and threatened to smear officers with his urine-soaked hands during booking.
Nicholas was also cited for OWI-first offense and operating left of center. He was released on a signature bond.
He ultimately pleaded guilty to the felony threat charge on July 23, 2025. The two misdemeanor counts and the traffic citation for operating left of center were dismissed. He was sentenced to 10 days in jail, which he began serving the same day. His driver’s license was revoked for six months as part of the OWI conviction.
