KENOSHA, Wis. — A 42-year-old Kenosha man was charged Monday with his fourth offense of operating while intoxicated after police say he crashed into a legally parked vehicle on 25th Avenue.

According to the criminal complaint, Justin J. Johnson struck a Dodge Ram pickup truck around 8:40 p.m. Sunday while driving a white Chevy Equinox. Officers said Johnson appeared unsteady on his feet, slurred his speech and admitted to drinking at a bar earlier in the evening. He first told police he had consumed two drinks but later acknowledged taking three shots of alcohol.
During field sobriety tests, Johnson reportedly struggled to keep his balance and nearly fell several times before the test was stopped for his safety. A blood draw was taken at Froedtert Kenosha Hospital, though results were not available at the time of charging.
Records show Johnson has three prior OWI-related convictions in Dane and Rock counties dating back to 1999, 2003 and 2003. His latest charge is a Class H felony, which carries a maximum penalty of six years in prison and a $10,000 fine. Wisconsin law also requires a mandatory minimum of 60 days in jail for a fourth OWI conviction.
Court Commissioner William Michel II set Johnson’s bail at $3,500 on Monday. A preliminary hearing is scheduled for August 28.

It’s been 22 years since his last OWI One assumes he fell off the wagon. I hope this provides the wake up call he needed to return to recovery.
