KENOSHA, Wis. — A Kenosha man convicted of seriously injuring a motorcyclist while driving drunk was spared jail after Judge Jason Rossell imposed a sentence that amounts entirely to house arrest, despite the severity of the felony conviction and the extent of the victim’s injuries.

If this was the judges family member there would be no house arrest. Straight up prison time. This is called BLACK PRIVELAGE. Not surprising with that ULTRA-liberal ass judge.

The Sheriff decides whether or not a prisoner can serve their sentence on the ankle monitor. The Judge is merely expressing a preference which the Sheriff can ignore or honor.
It says that restitution to the victim has been paid in full… How much was the restitution? I would imagine the cost of the bike and the hospital bills for the type of injuries suffered must have been very substantial, at least likely in the mid 6 figures. So are we to assume the defendant paid this or was it his insurance company? If the latter this should have zero influence on the judges decision. The fact that he was twice the legal limit likely at least a hour after the accident and received zero probation even if this was his first offense is mind boggling.
Restitution isn’t the same thing as insurance costs and expenses. Insurance can’t pay restitution for a defendant.
either way- 3rd offense (non-felony) “requires” a minimum of 60 days in jail. This was a felony that hurt another person…… Wtf Rossell??? What is so “special” that you refuse to impose the mandated “minimum” sentence?? Judges and DA’s should be required to put a public explanation in CCAP for every sentence so regular citizens know why the sentence was so light.
