In the last five years, Kenosha Police Officer Nicholas J. Benvenuto has written more than 2,000 citations. That is more than 95% of law enforcement in the Kenosha area. In the same time period, he wrote 99 warnings. Benvenuto also does a seasonal motorcycle detail. In the 2023 season, from 4/1/2023 to 9/30/2023, Benvenuto wrote 489 citations. That’s about 100 per month.
When Benvenuto is on the motorcycle detail, it’s his job to keep the roads safe and write tickets. He does that. However, both on and off duty, Benvenuto doesn’t live up to his own expectations. If you write thousands of speeding tickets, you should drive the speed limit. Benvenuto probably speeds every day. We don’t know. We do know, however, that Benvenuto has been disciplined for on and off duty driving at least six times – he also has been disciplined for other reasons, such as lying in a police report. He has even served a 10-day unpaid suspension for erratic driving.

1-3. Benvenuto was on his way to court one day and off duty. He was driving down Sheridan Road and was clocked by an on-duty police officer doing 52 in a 30 zone. He drove so closely to the officer (that was on a traffic stop) that the officer abandoned the current traffic stop to go catch Benvenuto, not knowing who he was. The officer reported to a supervisor that Benvenuto was driving so fast and close to him, that he “shook the Squad.” When the officer approached the car, he recognized his co-worker and Benvenuto actually laughed, which pissed off the cop, who could have been hurt or even killed by Benvenuto’s unsafe driving. Benvenuto was issued a written reprimand, but no speeding ticket. It was noted in this disciplinary letter that Benvenuto had been “coached” twice by his Sergeant for violations with his driving while on duty.
4. Benvenuto was on patrol and had a priest in his squad car doing a ride-along. Benvenuto responded to a foot chase and was caught on his dash cam driving 58 mph and almost hitting a vehicle. Benvenuto was driving this fast with no lights or sirens activated. He later was driving 72 mph, and later 62 mph, all on city streets where the speed limit is usually 25. Benvenuto also had to lock up his brakes to avoid a collision with another police car at 52nd St and 26th Ave. Benvenuto was given another written warning.
5. Benvenuto exited his squad car and left the engine running and the car in drive. When he returned to the squad, he learned that it had struck a building. Benvenuto was issued a written warning.
6. Benvenuto responded to a traffic accident that he wasn’t dispatched to or requested to assist. He also failed to notify dispatchers of his response. Benvenuto traveled 84 mph down Alford Park drive, a 35 mph speed limit road. The other KPD Officer who was already on scene radioed to dispatch, “Slow it down, he’s ok.” The officer said this as to allow officers enroute to reduce speed and thus reduce the risk of injury to others. Police administrators don’t want their officers to speed unless it’s necessary. Even after being told the crash victim was “ok”, Benvenuto turned onto 7th Ave, a 25 mph zone, narrowly missing a bicyclist and was driving at 68 mph. Then-Chief John Morrissey seemed to have enough of this cop’s dangerous driving, writing in part:
“In reviewing your personnel file I find that you have significant documentation and discipline in reference to safe vehicle operation.
I find that significant disciplinary action is waranted in this case. Your operation of the squad in the manner described above is not within policy and was not with due regard. Your actions posed a risk to you, other officers responding to the scene, pedestrians and a bicyclist, as well as other vehicle operators.
I am disappointed and concerned by your actions here. I sincerely hope that you will make further disciplinary steps unnecessary and that you take the required steps to ensure that you operate departmental vehicles in a safe, responsible, intelligent, and lawful manner at all times. Further discipline can include removal from the Kenosha Police Department motor unit and up to an including termination.
Nicholas J. Benvenuto shall be suspended without pay for a total of 10 days”
7. Benvenuto was investigating a disorderly conduct incident. As part of his investigation he went to speak with an involved subject at a different location. He ended up arresting the individual who had his children with him.
Benvenuto did not write the report on time and due to the lack of his writing the report, the third shift supervisor that reviewed the arrest sheet became concerned as to the whereabouts of the three young children. This required follow-up investigation by another officer who was tasked with the assignment of locating the children who were eventually found to be safe. In Benvenuto’s report, he wrote an inaccurate statement that “the children were left in the care of *name redacted* until the father arrived.” A supervisor wrote, “This statement is not accurate. You admitted that you did not wait for the father of the children to arrive on scene and therefore would have no way of knowing whether or not he had arrived. You never had direct communication with the father but instead relied upon a third party to contact him. You did not follow proper procedure in regards to a training memo in regards to placement of children in juvenile crisis.” Benvenuto was reprimanded verbally.
What does all this mean? This means that Benvenuto ruins people’s days all the time. He seems to get joy in writing tickets. These are not serious tickets, either. He writes many minor citations almost every day. But he doesn’t hold himself to the same standard as those he punishes yet still expects special treatment. When he almost ran a cop over, he got a letter in his file where you or I would have been charged criminally. In fact, Benvenuto once charged a man (albeit, a criminal) with a felony for speeding off from a traffic stop. Benvenuto claimed his life was in danger. It clearly wasn’t. Benvenuto pulled a man over for driving 55 in a 35 on Alfred Park drive, the same road that benvenuto drove 84 mph on without lights or sirens before when he was suspended for two weeks. You can see Benvenuto in the reflection of the driver’s window. He didn’t even flinch. The felony was dismissed.
Nicholas. Do better man. Drive safe yourself, or stop writing tickets and extorting money from hard-working Kenosha residents for minor stuff. Lead by example. KPD has an excellent reputation today with excellent leadership at the very top, and you jeopardize it with your shenanigans. Do better.

(*Editor’s Note* Full disclosure – This Officer pulled me over on my Harley recently. Out of the five or six of us traveling at the same rate of speed, he chose me after we locked eyes. (He doesn’t like me.) He gave me shit for wearing crocs, which are very comfortable – even on a Harley. He tried to assert my insurance was expired. It expires in 2025 – his math was off. He demanded to see my CCW, even though my pistol was visible. He cited me for 45 in a 30 ($98 Citation) on 60th Street by Fire Station 4 where the speed limit should be at least 40. He utilizes this as a speed trap. Those of you who will chastise my choice of footwear while out for a morning cruise, don’t know the true comfort and convenience of the Crocs. All of that aside, all of the above is true and accurate. Is there some sour grapes here? Sure. I looked into this guy after I got the ticket and was alarmed at what I discovered. I then decided to write this story.)

I live in Kenosha county west of the I. I see the county sheriff cars always driving 75-80 mph on hwy 50 for no apparent reason. Sleeping behind westosha central high. I am paying the gas bill for these guys cruising around at 75-80. One passed me yesterday at a high rate of speed. He pulled into the school and preceded to park in the back of the lot and do nothing. Crazy but it’s been that way for years

They actually go behind Westosha Central High to write their reports and fill out any paperwork. An out of the way semi private spot but still close enough to respond to calls. I did catch a Zion PD officer sleeping in his car one morning on my way to work….. he did not appreciate the pictures I emailed to every available email I could find online. You have to have irrefutable proof before any Cop will discipline one of their own.

I guess I’m lucky because he stopped me and said I gently rolled thru a stop sign off of Pershing and 52nd. He went to his car and came back and said since I have a clear driving record he just gave me a warning. I stopped at the sign as I always do (my wife says I drive like a grandma) but there was no way I was going to argue with him. I know he has a job to do but just seemed to be enjoying it a bit much.

No, the masks that most individuals were wearing did nothing to slow or stop the spread of the coronavirus. The cloth masks & bandanas and/or paper masks were the biggest joke of the “pandemic.” Especially since most weren’t disposed of properly, and the majority of the people wearing them were mishandling them, which was more of an infection control disaster than any help.
Properly fitted, properly used N-95 masks were barely effective.
Smart people social distanced, practiced good handwashing, loaded up on Vitamin D and Calcium, Magnesium, and Zinc, and ate healthy diets to help protect their immune system.

Whether he’s butt hurt about that or not he’s still telling the truth, I’ve witnessed police speeding a lot or they turn on their sirens to go through red lights and then cut them off when they go through the light just to not wait in traffic.
You don’t know why they turn on lights/siren to go through lights and then turn them off. Some calls require emergency response (lights/siren) but also a level of stealth/quiet approach(maybe a robbery with possible hostages; would you want the bad guy warned that the cops were coming if you were a potential hostage?) So, the lights are to get through traffic signals, then shut down to keep the element of surprise. Sirens can be heard for quite a distance, so they need to be cut early enough to not give warning to the criminals the officers are trying to apprehend.
There is a big dishonesty problem at the Kenosha Police Department. There has been for many years. Rookie cops are taught their word is believed over others in nearly every instance—even when it is flatly contradicted by video evidence. It is part of their institutional culture.

It’s important for the context of this story to disclose when the discipline occurred. Did the heavy suspension that Chief Morrissey leveled change the behavior of the officer which is what the purpose of discipline is? Is the purpose of a traffic citation to curb behavior such as speeding? Maybe a little discipline worked and will work in both cases. Food for thought.

While I do not know the officer mentioned here, it does seem like a lot of tickets he writes. I also cannot attest to the types of calls that officers may be responding to that appeared unsafe. There are times to ‘ramp it up’ a little to get somewhere but one has to be safe and use what’s called due regard. That said, all the anonymous commenters love to hide behind their phone/computer screens and make their comments. It’s easy to judge from the other side if you’re not willing to step up and do a ride along, much less do the job yourself. I’m sorry some of you have had a negative experience- I don’t like the police behind me….and I am one. They aren’t the enemy 99.9% of the time.

I had to make a report last summer and Officer Benvenuto was the KPD officer who helped me. It didn’t involve a traffic stop, so I can’t comment on that, but I will say that Officer Benvenuto really went above and beyond in order to help me. I know this is only one person’s experience, but he was very professional and really helped me. I had a very positive experience with him as a representative of the KPD.

You must not use Sheridan road during “rush hours” when folks tailgate you if are “only” doing 45mph in a 30, and often hit 70mph when there’s an opening in the other lane. One little thing goes wrong, and what should be a minor fender bender becomes a fatal accident or another smashed building.
Just because a cop writes tickets and speeds him or herself does not matter to me. On the clock, they are doing the business of the county or city. They aren’t getting the money themselves. Kenosha PD sends out traffic enforcement to write tickets and enforce safe driving. Our other local villages without police pay KSD to patrol and require tickets to be written. That’s not on the cop, that is the way the system is set up. I don’t call them hypocrites for doing the job they are told to do. It’s no different than a sales employee selling a product they don’t own or use.

Fair disclosure, I got a ticket for going 50 in a 30 a few weeks ago when no other cars were around. The cop was nice….but like, come on, you don’t have better things to be doing? I’d be embarrassed to be writing traffic tickets as a cop in 2024.

One of the things I was taught in the police academy was that you don’t write citations to people for what you do yourself. Another was to see yourself as others see you which means leadership by example.
“Nine you’re fine, ten you’re mine” Is a safe (but not entirely foolproof) bet in most of Wisconsin. If you drive more than ten miles over the speed limit you run the risk of getting a citation.
There has been a proliferation of “chicken shit” tickets written by more than one police officer in our area. Some of them — very minor equipment issues — used to be addressed by “fix it” tickets where the driver would get five or 15 days to take care of the problem. Now people are getting citations right off the rail and I wonder what would happen if someone insisted that a police officer get a ticket for driving a squad car with a burned out license plate light!
As for money grabbing, here’s a harsh reality check. If you get a ticket for, say, ten over from an officer in a place with a municipal court, it’s usually $98.80. If the same violation is written by a deputy sheriff or state patrol trooper in circuit court it’s $175.30. In fact, EVERY citation in circuit courts in Wisconsin is $76.50 more expensive. The Racine County Sheriff himself brags about how much money his deputies bring in from I94 patrols. Why should the badge the officer wears dictate how much a ticket will cost you?

Everyone here is quick to point fingers instead of considering the entire situation. From what I’ve observed, DeFazio seems to dislike the police and has mental health issues. This is quite evident in the video. He appears almost cocky, with his window partially rolled down, arguing at every turn. He says, “I only have the policy number; they don’t give cards anymore.” I don’t think most people could stay calm when someone is arguing and cussing at them, so I believe the officer did well to maintain his composure. I’ve never seen an officer make someone park without insurance; usually, it’s for not having a license. Did the officer decide to have him park because of his behavior and possibly abuse his authority? It’s hard to say.
Don’t forget when he has to call mommy to help him. Dudes almost 50 calling mommy to help him
A motorcycle officer is a traffic enforcement cop, pure and simple. 100 citations per month equals about 5 per work day. Not a lot for a motorcycle cop. With the way many people drive in this town you could probably find five violations in an hour!
Now if his tickets are bad and/or his own driving is a problem, that’s another story.

I watched the video. Most of the stop went OK although I would not have asked, “Do you know why I stopped you?” A person may not legitimately know and it can come off as a bit snarky.
Should have been: “I’m officer Benvenuto and the reason I stopped you is because I clocked you on radar exceeding the 35 miles per hour speed limit. (If I am giving a warning I would not say how fast he was driving otherwise I would and say that “I will be issuing you a citation for speeding.”) May I have your driver’s license and proof of insurance? Thank you. I’ll be back shortly.”
Benvenuto actually handled most of the insurance problem well. He’s wrong that only a card is proof of insurance. Someone could carry with them the policy declarations page, for example, which actually gives more information than a card. He was right, though, about the documentation having the correct dates. That said, in any event I would not have hassled the driver and just issued the citation, telling him that if he has proof of valid current insurance he should bring it to court and the citation would be dismissed.
As for the driver squealing tires and speeding off, that could be the basis for a second stop but not necessarily a custodial arrest. I don’t see it rising to a felony level but it could have been the basis for a citation for either unreasonable and imprudent speed or even reckless driving. Videos don’t show everything and I wasn’t there but the officer could have handled this a lot better. It was fairly evident that the driver probably had insurance but he didn’t have proof which is actually a $10 ticket that must be dismissed upon proof of valid coverage. And he could have said, “Sir, technically the law says you can’t drive without insurance and proof of insurance. I’m leaving now and what I don’t see, I don’t see so you might want to wait and then go home and find your insurance card.”
But crocs on a Harley? I couldn’t get that vision out of my mind at the mall when I saw Crocs on display.

I was born in Kenosha living there until age 23. I’m 60 years old today and live in Phoenix AZ for last 14 years. I see this and thank God above that I am gone. Here in Phoenix this would never happen. Just incredible to imagine living amongst law enforcement with such evil intentions.
This cop is a psycho idiot . Any of you Kenosha residents who think this arrest is cool just because the guy has a record deserve Kenosha, please stay there for the rest of your life. Kenosha WI is a depressing miserable place run by arrogant self righteous cops and led by the same types in Madison. Take it from someone who has lived in Kenosha for the first half of his life and finally escaped, I promise you you just don’t know what you are missing. For God sake unless you have a reason to remain in desolation get free while you can. I’m here to tell you law enforcement isn’t like this everywhere else. In Phoenix cops are polite and friendly even if you have a record or homeless. The only time I ever got treated like this was when I was disrespectful and didn’t listen. This dude was provoked and encouraged and the cop escalated it. Honestly, good people deserve better than this. I couldn’t allow myself to be policed by him.
And by the way, kudos to the author. So you had a personal motivation to investigate this cop, it’s not relevant to his record. Good that you disclosed it but it doesn’t change anything about the cop. Hey Officer Benvenuto, you are unethical, unprofessional and without a conscience. I have no doubt that you have deeper issues, deep psychological pathology, something that is soothed by inflicting suffering upon others. Man it’s totally obvious. I see local police and sheriff speeding all the time. It’s especially bad around shift change as the sheriff deputies speed from the interstate to downtown.
A Black citizen would never get this much leeway from the police, so I understand how that community must feel when they see a video like this. To not have the insurance card, to curse the cop out and not listen to him when he says “pull you car into the lot.” A Black citizen would have been in jail or worse. What happened to “just follow the officers instructions?” Yes the officer should not be driving wrecklessly himself on or off duty. I support the discipline metted out to him. I don’t have a problem with him writing tickets as that is his job. Drive safely and all of this is avoided.
