KENOSHA, Wis. — The parents of a 17-year-old Kenosha student with severe disabilities have filed a federal lawsuit against the Kenosha Unified School District, accusing administrators of ignoring medical recommendations, failing to follow her education plan, and subjecting her to undignified treatment during the school day.

I’m on the students side with this one.
I agree. And the parents are not seeking massive amounts of money , they just want legal fees to be paid.
This is not surprising. Children with medical disabilities attending a KUSD school are routinely denied 504 plans (which is illegal) and are encouraged to instead write up flimsy “care plans” that are not followed by staff and have no legal backing. Even when a student with a medical disability is allowed a 504, these are rarely followed and often ignored completely. I’m surprised there are not more of these lawsuits.
That was my experience as well. My child has a serious medical disability that requires careful monitoring and care 24/7, and the school psychologist repeatedly insinuated that my child wasn’t disabled enough to even discuss her having a 504 plan. The school wrote up a generic “medical plan” and said that was all she needed. My child’s doctor said he was “shocked” to see a school district so blatantly try to deny a student’s rights. It was awful!
