Rittenhouse Prosecutor T. Clair Binger Resigns From DA’s Office, Re-hired 47 Days Later – Where Did He Go?

Tom Binger (D) was made famous, or infamous, however you look at it, in 2020 and 2021. Binger was the Kyle Rittenhouse prosecutor that lost every single charge levied against Kyle Rittenhouse, a then-17-year-old who killed two men and injured a third in what the jury ruled as self-defense shootings.

Kenosha County District Attorney Michael Graveley (D) pawned the case off on Binger because Graveley knew that obtaining convictions against Rittenhouse was impossible, and thus, unethical. Ethics rules preclude prosecutors from bringing cases forward that they know they cannot win. Former Deputy District Attorney and now-Judge Angelina Gabriele said it best on a documentary about Mark Jensen:

According to documents obtained by KCE from Binger’s personnel file, he resigned his position as assistant district attorney on March 3, 2023 to “take another legal position.”

On April 19, 2023, only 46 days later, District Attorney Mike Gravley re-hired Binger to the team, continuing his almost $100,000 salary.

But where was Binger for those 46 days? He won’t say – neither will his boss. Binger doesn’t seem content forking for the Kenosha County District Attorney’s office – in fact, he’s tried to leave many times. Binger was hired by the Kenosha County DA’s office on September 4, 2014.

Just two years later, Binger ran for Racine County DA in 2016 and lost by a large margin.

In 2018, Binger applied to be a Kenosha County Court Commissioner, and the Kenosha judges rejected his bid.

In 2019, Binger made an attempt to be appointed by the Racine City Council to be the City’s Municipal Judge. He received zero votes from the elected City Council. Watch his plea to the council below.

KCE is aware or several other attempts to get out of the DA’s office by Binger. It seems that no one wants to employ him, of course with the exception of Michael Graveley. Both share the same lack of integrity, moral character, and ethics.

  7. I am a legal afficionado. I was amazed at the incompetence of Mr. Binger during the Rittenhouse trial. From annoying judge Schroeder, to injecting his sniveling , spineless ideology into a trial where it didn’t belong . Of course his fellow liberal , Michael Gravely threw him under the bus.
    The case against Kyle Rittenhouse may have been unwinnable anyway , but putting Binger and his equally useless sidekick , sealed it’s doom.
    Mr. Binger’s astonishing lack of self awareness ,
    eliminates him from any discussion of successful lawyers. He needed the nearly 2 months to recover from his abject failure . Then Gravely took him back out of feelings of guilt. It pays to have friends in high places…
