KENOSHA, Wis. — A 16-year-old accused of bringing a handgun into the corn maze at Jerry Smith Pumpkin Farm, one of Kenosha County’s most beloved family destinations, has been identified by Kenosha County Eye as Jose Emanuel Cruz. The teenager was detained Friday evening, October 9, 2026, after security personnel reported a possible armed individual inside the popular attraction. Deputies ultimately recovered an unloaded 9mm handgun and an empty 30-round magazine from the corn maze. Cruz has a history of previous law enforcement contacts, including weapons-related complaints, raising questions about how the juvenile justice system will handle his latest encounter with law enforcement.

Kenosha County Eye made the difficult editorial decision to identify Cruz in the interest of transparency and public safety. Although juvenile proceedings are generally handled differently from adult criminal cases, the allegations involve a firearm brought into a family-oriented attraction where parents and children should always feel safe. KCE believes the public has a legitimate interest in knowing who was involved, particularly given the teenager’s previous encounters with law enforcement.

According to the Kenosha County Sheriff’s Office, deputies were dispatched to Jerry Smith Pumpkin Farm at approximately 8:03 p.m. after receiving information that a male inside the corn maze might have a handgun. Security personnel were already investigating the report, and deputies responded to locate the individual and determine whether a weapon was present.

Deputies detained Cruz, who matched the description provided by witnesses. Officers initially found no firearm on his person, raising questions about whether the reported weapon existed. Investigators subsequently learned that Cruz may have discarded a handgun somewhere in the corn maze, prompting a search of the surrounding area.

The investigation ultimately led to the recovery of an unloaded 9mm handgun and an empty 30-round magazine. K9 Riv assisted in locating the evidence, helping deputies resolve a situation that could have had far more serious consequences. Deputies also recovered a vape pen that reportedly tested presumptively positive for THC.

The Sheriff’s Office recommended charges of possession of a dangerous weapon by a person under 18, disorderly conduct while armed, carrying a concealed weapon and possession of THC.

Previous Weapons-Related Police Contacts
Cruz was involved in a weapons-related police call in 2024. His previous interactions with law enforcement also included traffic stops and a reported burglary attempt.

Paid Advertisement

Of particular concern was an April 21, 2026, weapons-related call involving an argument between Cruz and his sister. His sister reported that Cruz threatened to use a gun during the argument. She told authorities that he previously possessed a firearm, although she had not seen one that day. Authorities did not establish whether Cruz actually possessed a firearm during that incident.

Another previous incident involved Cruz reportedly being found with a realistic-looking Orbeez gun at school. These earlier incidents do not establish that Cruz committed a crime in connection with those complaints, but they raise questions about how authorities responded to previous warnings involving weapons.

Juvenile Court Proceedings Expected This Week
Cruz is expected to appear in juvenile court later this week. Two judges who could potentially be assigned to his case are Kenosha County Circuit Court Judge Gerad Dougvillo and Judge Chad Kerkman (D). Which judge receives the case could have significant implications if prosecutors ask to waive Cruz into adult court.

Dougvillo is regarded as a tough-on-crime judge. Kerkman, by contrast, has drawn criticism from Kenosha County Eye for what the publication considers an extremely soft-on-crime approach to serious juvenile offenders. His handling of another teenager who brought a handgun into a place where children should feel safe illustrates why his potential assignment to Cruz’s case is significant.

In December 2024, 16-year-old Jahheem P. Wright brought a loaded handgun into Indian Trail High School and Academy and made threats that alarmed students. Prosecutors sought to waive Wright into adult court, but Kerkman rejected that request. Wright ultimately pleaded guilty to two felony offenses in juvenile court and received a one-year juvenile detention sentence.

Now 18, Wright was arrested again on October 7, 2026, after police attempted to locate him in connection with a shooting investigation. According to the new criminal complaint, Wright fled from officers and physically resisted their attempts to arrest him. He was charged with resisting and obstructing an officer and subsequently released on no-cash bail. The complaint does not establish that Wright participated in the shooting being investigated.

Kerkman’s previous decision to deny adult prosecution in Wright’s case raises legitimate questions about how he would approach a similar request involving Cruz. Given that history, KCE believes Kerkman would be unlikely to grant an adult-court waiver, while Dougvillo may be more receptive to such a request. Neither outcome is certain, and prosecutors have not confirmed whether they will seek a waiver.

Questions About Juvenile Intake And Detention
Kenosha County Juvenile Court Intake Director Mary Lynn Beier oversees an office with substantial influence over what happens to juveniles following law enforcement referrals. Juvenile intake personnel assess cases and make recommendations to the court under Wisconsin’s juvenile justice laws.

Kenosha County Eye has criticized Beier’s approach to juvenile detention, characterizing her as a liberal activist who favors releasing juvenile offenders rather than keeping them in secure custody while their cases proceed. KCE has been told that juvenile intake personnel worked to facilitate Cruz’s return home following the pumpkin farm incident. However, the newspaper has not established whether Beier personally made or directed a particular decision in his case.

The Sheriff’s Office initially reported that Cruz was released to a parent with restrictions. However, a source familiar with the situation told KCE that they believe Cruz is now being held in secure juvenile detention. KCE has not independently confirmed whether he remains at home or has subsequently been placed in detention.

The question now is whether a teenager accused of bringing a handgun into a family attraction, with previous weapons-related police contacts, should remain in secure detention while the court determines how to proceed. That decision carries consequences not only for Cruz and his family, but also for the broader community.

Sheriff’s Office Praised For Response
The Kenosha County Sheriff’s Office handled the incident with professionalism and urgency. Deputies responded to a potentially dangerous situation at a busy public attraction, quickly located and detained Cruz, and continued investigating even after no firearm was initially found on his person.

Their persistence paid off when the handgun and magazine were recovered from the corn maze. The successful response demonstrated the importance of coordinated communication between dispatchers, deputies, security personnel and K9 resources.

For the families who visit Jerry Smith Pumpkin Farm each fall, the corn maze is supposed to be a place for laughter, excitement and cherished memories, not a place where deputies must search for a discarded handgun. The Sheriff’s Office did its job exceptionally well that evening. The next questions concern how the juvenile justice system will handle Cruz’s case and what measures will be taken to protect the public.
