The white-glove treatment of a Kenosha man continues. Yesterday, in the Kenosha County Courthouse, Trenton B. Kmiec was sentenced for three felony cases in Kenosha County. Kmiec was facing one count of Felony Possession of Narcotic Drugs, Felony Physical Abuse of a Child, Intimidation of a Victim, Obstructing an Officer, and (11) counts of Felony Bail Jumping.

Kmiec was facing a maximum sentence just shy of 75 years in prison. A Kenosha Judge yesterday jumped an overly-generous plea deal. “Jumping” is when a judge is stricter with sentencing than the joint recommendation suggests. The DA’s office decides the penalties in criminal cases more than 90% of the time.

In this case, Kenosha DA Mike Graveley gave the prosecution to the Racine County DA’s office. DDA Steenrod took the Kmiec cases, but told KCE after the hearing that the DA, Patricia Hanson made the decisions on this case.
In court Monday were Kmiec’s parents, Connie and Ted. Ted, a local attorney warmly greeted Steenrod before the trial, “hey Chris,” the lawyer told the prosecutor. “Hey Ted,” the prosecutor said back.

Steenrod agreed to dismiss most of the charges. All that remained, and were pled guilty to, were (4) counts of Felony Bail Jumping, Obstructing the Police, Disorderly Conduct, and Intimidating a Victim. Steenrod recommended time served and three years of probation. Judges Gerad Dougvillo gave Kmiec a long lecture and admitted that the public was only safe from Kmiec’s crimes while Kmiec was behind bars. Dougvillo gave Kmiec three years of probation and 212 days in jail. 90 days of that sentence remain.

Prior Criminal Convictions
Judge Dougvillo was told about Kmiec’s criminal past, but the prosecutor tried to conceal from the judge a pending criminal case in Fond du Lac.
Kmiec was found guilty of three felonies from Winnebago County – Possession w/Intent-Cocaine, More Than 5 Ounces, Felony Bail Jumping, and Maintaining a Drug Trafficking Place. A liberal judge in Winnebago County gave Kmiec probation only – no jail or prison. Kmiec also has a pair of OWI’s.
Fond du Lac County Armed Pursuit
The most serious of Kmiec’s six felony cases spanning three counties, however, has yet to be decided.
On November 24, 2021, police and prosecutors say that Kmiec lead multiple police officers and agencies on a 25 minute long, 22 mile police chase while armed and under the influence of drugs. Kmiec refused to pull over for police and drove erratically at speeds up to 85 miles per hour. He endangered many people’s lives by swerving all over the road and narrowly missing innocent bystanders. At one point he swerved around stop sticks, was rammed by police, did a 360 degree spin, but continued to evade. Eventually, Kmiec flipped the car and crashed in a ditch. Police found a Glock 19 in his possession with an extended 30-round magazine in the car. A drug recognition expert determined that Kmiec was under the influence of stimulants. There were also empty bottles of Cyclobenzaprine and Tramadol in his upside down car. Kmiec also had two Buprenorphine narcotic patches on his body. Kmiec also had a powdery substance on his nostril. Kmiec was charged with (1) Second Degree Recklessly Endangering Safety, Use of a Dangerous Weapon, (2) Fleeing and Eluding – Causing Damage to Property, Use of a Dangerous Weapon, (3) Felony Criminal Damage to Property, Use of a Dangerous Weapon, (4) Possession of a Firearm While Intoxicated, and (5) OWI (2nd). One of the victims told police that Kmiec caused $8,000 in damage to his property. Believe it or not, Governor Evers (D) appointee, Judge Tricia Walker, gave Kmiec a no-cash bond. He was released without having to pay a cent. He is awaiting trial for this case.

Before court on Monday, Connie Kmiec verbally accosted me in the presence of my 13-year-old son. If you want to use foul language towards me becuase I put your mugshot on my website, so be it, but not in front of my minor child. That’s when the line is crossed. She tried to intimidate me into not reporting on her multiple felon son. The entire interaction was captured on court-house surveillance. Her and her husband Ted asked for the Sheriff’s Department to arrest me for “disorderly conduct” for covering the story. The Sheriff’s Department politely declined to arrest me. Here is the video:

There are some important pieces missing from the story. One is what was the judge’s explanation for the sentence? Another is whether the pre-sentence investigation recommended more or less than the prosecutor’s recommendation? And then why did this judge keep the case and not recuse himself?
DA Gravely gets beat up on a lot around here but this time he made the right call and sent the case outside of his office. I would think that the judges would have followed suit.
Kmiec isn’t the first and won’t the the last parent to have a kid get in trouble, especially with drugs. Some families have gone bankrupt as a result of trying to help kids like that and it still doesn’t work. Beyond that sympathy for Kmiec runs thin as he himself seems to be too close to the flame. Having said this, I don’t expect parents to abandon their kids and, as a lawyer, Kmiec can’t be faulted if, for example, he felt that his son’s rights were infringed or needs ignored. I get the sense that didn’t happen here. The younger Kmiec is obviously a crime wave unto himself.
Let’s keep the eye on the ball here. Mrs. Kmiec’s purported potty mouth is chump change compared to the threat her son poses to himself and the community and whether the judge adequately addressed that in his sentence plus, of course, whether this judge should have stayed on the case in the first place.

And, frankly, just putting this kid on probation may not help him, either. It’s unlikely that he’s going to change his ways on a dime. Probation could be a prescription for failure.

I have studied theology for many years, taught at a Catholic school, and certainly no where in the gospels does it say to judge, hate, and ridicule people. In fact, the gospels say just the opposite. They say let those without sin cast the first stone, and love your neighbor as yourself. The gospels main theme is “love and forgiveness.” I don’t see any forgiving statements or loving supportive statements in any of these stories, or posts.
