
SALEM LAKES, Wis. — A 55-year-old Salem man has been charged with his fourth drunken driving offense after deputies say they found him vomiting on the side of the road with an open bottle of vodka in his car.
Peter C. Wagner was charged Thursday in Kenosha County Circuit Court with operating a motor vehicle while under the influence, fourth offense. The charge carries a maximum penalty of six years in prison and a $10,000 fine.
Court Commissioner William Michel II set Wagner’s cash bail at $5,000 and scheduled a preliminary hearing for Aug. 28. Wagner did not appear in court because he is currently hospitalized, though details about his condition were not disclosed.
According to the criminal complaint, a Kenosha County sheriff’s deputy came across Wagner’s Jeep pulled over on Highway 83 in Bristol on Aug. 20. The deputy reported seeing Wagner vomiting in the grass before getting back into the driver’s seat. The vehicle was still running.
When the deputy approached, he noticed signs of intoxication, including bloodshot eyes, slurred speech, unsteady balance and the smell of alcohol. Wagner allegedly had vomit near his car and feces on his shorts. Deputies also found an open SKOL vodka flask in the driver’s door.
Wagner refused a preliminary breath test but consented to a blood draw. The results were not yet available at the time of filing. His driving record shows three prior OWI-related convictions: in Ohio in 1993, Lake County, Illinois in 2002, and Kenosha County in 2006.
If convicted, Wagner faces a mandatory minimum of 60 days in jail in addition to the possibility of up to six years in prison.

Agreed. Hopefully, he will find the key to rise above the demons that feed off and drive him so to realize inner peace.
