
KENOSHA, Wis. — A 40-year-old Wauwatosa man accused of stealing hundreds of dollars’ worth of spray paint and craft supplies from two Kenosha stores is now facing an additional felony after failing to show up for his court date — less than a week after being released on a $1,000 cash bail.
According to two criminal complaints filed in Kenosha County Circuit Court, Troy L. Mosby was charged on October 2 with two counts of felony retail theft as a party to a crime. Police say he and another man were caught stealing roughly $1,262 in merchandise from Michaels and another $966 from Lowe’s on Green Bay Road the same afternoon.
Kenosha Police stopped a black Jeep Gladiator shortly after the thefts and allegedly found stolen items in plain view, including spray paint cans and a cart from Michaels. Mosby was arrested and charged with two Class I felonies, each carrying a maximum of 3½ years in prison and a $10,000 fine.
Despite the seriousness of the coordinated thefts, Court Commissioner William Michel II set Mosby’s bail at $1,000 cash, which he promptly posted to secure his release.
A week later, Mosby failed to appear for his preliminary hearing before Court Commissioner Michael Masnica. The Kenosha County District Attorney’s Office, led by DA Xavier Solis, has since charged him with felony bail jumping, which carries up to six years in prison.
While every defendant is presumed innocent, it’s hard not to wonder whether a higher bail might have prevented this predictable outcome. Serious felony charges, especially those involving multiple coordinated thefts, typically warrant tighter conditions to ensure a defendant shows up in court. Instead, Mosby’s low bail appears to have allowed him to vanish before the case could even get off the ground.
