Bristol Lawyer Files Complaint With Kenosha DA, Accusing Alderman Of Ethical and Criminal Violations For Conflict With Casino

KCE can confirm that a Bristol resident, who is also an attorney has asked District Attorney Michael Graveley to look into allegations of potential criminal and ethical violations committed by Alderman Anthony Kennedy. According to the complaint, by voting “yes” on the casino, Kennedy violated section 946.13(1)(b) which states that:

“Any public officer or public employee who does any of the following is guilty of a Class I felony: In the officer’s or employee’s capacity as such officer or employee, participates in the making of a contract in which the officer or employee has a private pecuniary interest, direct or indirect, or performs in regard to that contract some function requiring the exercise of discretion on the officer’s or employee’s part.”

The complaint, submitted to the DA’s office today states:

“Alderman Kennedy met with the Menominee tribe and Hard Rock casino before he voted in favor of an agreement with the City of Kenosha, and stated that he fulfills minority hiring requirements for work he performs for Illinois casinos. Prior to his supporting vote, Alderman Kennedy conditioned it upon his ability to work and profit from the Kenosha casino in a similar capacity. It is clear that Alderman Kennedy has a financial interest in the proposed casino development.”

As a basis for the complaint, the attorney points out Kennedy’s own words, that he spoke just before he pushed the “yes” button at a recent City Council meeting.

Graveley’s office has taken between two and six months to review such complaints.

Kenosha Alderman David Bogdala (R) voted in support of the casino even though his district voted overwhelmingly against the casino twice. He has spoken in opposition to the casino publically at least 10 times, but now that he’s a candidate for mayor, had reneged on his promise to his district.

Bogdala successfully passed an amendment to the City’s IGA that prohibited City employees and elected officials from working for the Menominee, but stopped short of adding the Hard Rock or other possible employers on the property.

County Executive Samantha Kerkman had the following to say about the County’s IGA:

“I’m supportive of adding language equivalent to what the city included in its agreement. In addition, I’d like to incorporate a more complete conflict-of-interest section into our county ethics ordinance review that we are going to be working on this spring.”

Reached by phone Tuesday evening, Kennedy first said that he wouldn’t comment, but later changed his mind and said “I have no conflict.”

No matter how you feel about this, as the gentleman is speaking about his life & military service, Gentz is leaning his head back and looking annoyed, and Berg playing on his phone. It’s a bad look. It shows that those two lack the basic respect for someone who took time to address them & answer their questions.

    Does Alderman Kennedy have a personal financial interest in a contract? Maybe at some point he could and that would then be more clear but the issue is whether at the time the city council voted did he actually have a financial interest in a contract? It may smell shady but if there’s ambiguity it’s hard to conceive how a violation could be proven beyond a reasonable doubt.

But socalist be socalist and with that being said he will always feather his own nest before giving his district the representation they deserve. Kenosha City and county governments are filled to the brim with leftist democrats . So let us not complain when an elected offical looks out after his own pocketbook before the people he serves.   6. It becomes more obvious everyday that all these elected officials voting in favor of casino each received an envelope full of cash.
    You can already start following the money on this deal. All while throwing Kenosha residents under the bus.
    Can someone answer the question of, what is a good paying job?

    1. Aside from the fact that they’re NOT voting on a casino. They’re voting on an IGA, and thinking that the Governor would say “no” to the casino simply because there local municipalities said no to the IGAs is shortsighted.

      They had to vote yes, because otherwise they would be up a creek without any sort of financial protection when the casino does come to town. Better to let them approve the IGA & then write to the Governor to ask him to not approve this.

      1. So not true. Why was there an all-out press (did you county how many tribe members drove down?) to convince the County to approve the IGA if the Tribe didn’t need the County’s support? If the County had said no, it would have sent a strong message that the County is not supporting this. If the governor really wants a casino in Kenosha and the County had voted no, he could have forced the County to reach an agreement with the Tribe as a condition of his approval. County was weak in its negotiations and that stems from the leader on down.

      2. If Kenosha residents voted it down, no way the governor would support it. This is all an Antaramian payback to the Menominee. What is in it for him, you ask?

  8. Would love a story on the Kenosha County Board meeting last night, with commentary. I watched the meeting and found several things concerning. First and foremost is the fact that Nudo has been missing for two months now, and he’s supposed to be the chair. Things seem to be running smoother with Decker behind the gavel, but with Nudo being missing for so long now, especially during something so pivotal for Kenosha County, he should not be on the ballot for April. He has been a disappointment all along, and now he’s MIA. The board needs to replace him as chair and let Decker take over so she can just do the job without her hands tied.

Fukken cowards, all of them, not letting the people vote on such an important topic but hiding behind the old story of “you voted for me to represent you”. No candidate puts out a paper stating exactly what they promised to do on any subject from Martian invasion to Florida Indian tribes, to alternate parking, and when something as big as signing away land forever in exchange for chump change and an overall monetary loss in the long run, people have a right to discuss it and vote on a binding referendum. Kenosha hasn’t had a casino since before it stopped being Kenozia, and having one now isn’t going to keep the tax and spend government we keep having from spending a $1.10 for every dollar they bring in.
