KENOSHA, Wis. — Former Kenosha County Board Supervisor, former Wisconsin Department of Corrections sergeant and amateur gay pornography performer Andrew A. “Andy” Berg, 48, of Kenosha, is back in the Kenosha County Jail after the Kenosha Drug Operations Group executed another search warrant at his home Tuesday. Berg, who was already free after posting $75,000 cash bail in a sweeping drug and gun prosecution, was arrested and booked at 1:56 p.m. Sept. 15, 2026. Law enforcement is now recommending seven additional felonies and three misdemeanors, including new drug trafficking allegations and felony bail jumping. Formal charges had not yet been filed as of Wednesday morning, but Berg is expected to be charged.

The latest arrest comes about nine months after KDOG investigators searched the same Kenosha residence in December 2025, leading to Berg’s existing prosecution on numerous felony drug and firearm charges. The newest jail booking lists recommendations for manufacture or delivery of PCP, methcathinone or amphetamine, 10 to 50 grams; manufacture or delivery of more than one but less than five grams of cocaine; manufacture or delivery of a prescription drug; maintaining a drug trafficking place; possession with intent to deliver prescription drugs; felony possession of methamphetamine-related drug paraphernalia; and felony bail jumping.

Three misdemeanor recommendations are also listed: possession of marijuana, possession of cocaine and possession with intent to inhale or intentionally inhaling a hazardous substance. Berg is listed as a newly charged prisoner housed in the pretrial facility. The jail system currently shows a total bond amount of $600. The Sheriff’s Office cautions that the charges listed at booking are those issued by the arresting agency and may differ from the final charges ultimately filed by prosecutors.

Already Facing Sweeping Drug And Gun Case
Berg’s latest arrest occurred while he remains a defendant in Kenosha County Case 2025CF1783, a major drug and firearms prosecution stemming from the December 2025 KDOG investigation.

The amended criminal complaint accuses Berg of three separate deliveries of more than 50 grams of GHB, each a Class C felony carrying up to 40 years in prison. He also faces THC and psilocybin delivery charges, two alleged straw purchases of firearms, possession with intent to deliver more than 50 grams of methamphetamine near a park, maintaining a drug trafficking place, child neglect and other drug-related allegations.

Investigators alleged that dangerous drugs and unsecured firearms were accessible inside the home while Berg’s then-11-year-old daughter was there. Detective reports incorporated into the complaint described firearms stored in unlocked drawers and raised concerns about GHB and methamphetamine exposure.

Kenosha County District Attorney Xavier Solis initially sought $300,000 cash bail. The court instead ordered $75,000 cash. Berg’s father, Walter Berg, posted the entire amount on Dec. 17, 2025, using a $70,000 check and a $5,000 money order.

Berg subsequently sought changes to his release conditions. Court Commissioner William Michel II modified the bond to allow Berg to return to the Kenosha residence while keeping the $75,000 cash requirement intact. Berg later sought another reduction after co-defendant Laura Mercado obtained no-cash bail, arguing in part that the money could be used for legal expenses. That request was denied.

Now, the residence Berg fought to return to has again been searched by KDOG, and investigators are recommending another group of felony drug charges.

Daughter Removed From Berg’s Custody
The December investigation also resulted in major consequences in Berg’s family court case.

A court initially removed Berg’s custody and placement of his daughter on an emergency basis after allegations that the child had been exposed to an environment containing drugs, drug paraphernalia and firearms. At a later contested hearing, Family Court Commissioner Alexandra Smathers heard testimony from Berg before ruling that he would have no custody or contact with his daughter at that time.

“The court finds that continued placement would endanger the child,” Smathers said from the bench.

The custody proceeding came only months after Berg was found in contempt for willfully failing to pay child support for nearly a year. In September 2025, Smathers imposed 120 days in the Kenosha County Jail, stayed as long as Berg complied with purge conditions that included remaining current on support and applying for jobs during weeks in which he failed to pay.

“Sergeant Hard” Pornography Revelations
Berg’s controversies stretch back years.

In December 2023, KCE reported that Berg, then both a Kenosha County Board supervisor and Wisconsin prison correctional sergeant, had been producing amateur gay pornography under the name “Sergeant Hard.” The material was produced while Berg remained a public official and state employee.

Berg was later accused by a local activist of sexual harassment and sending an unsolicited explicit photograph. Those allegations were reported by KCE but did not result in the pending criminal charges discussed in this story.

Fired From Wisconsin Department Of Corrections
Berg was fired from the Wisconsin Department of Corrections in October 2024 following an internal investigation into his workplace conduct.

KCE later obtained records showing investigators found campaign-related materials and political activity on state computers. The investigation also examined allegations that Berg used government resources while gathering information about KCE Editor Kevin Mathewson.

Berg’s DOC problems were not new. Earlier KCE reporting documented prior disciplinary matters involving his employment as a correctional sergeant.

Public Records Lawsuit And Election Controversies
Berg also lost a public-records lawsuit brought by KCE after failing to provide records requested from him in his capacity as a county supervisor. The court ordered Berg to comply with Wisconsin’s public-records law and imposed costs and fees. KCE subsequently returned to court seeking contempt after alleging that Berg still had not fully complied with the order.

During Berg’s unsuccessful 2024 reelection campaign, KCE also reported allegations that he used taxpayer-funded government resources for political purposes. Outside counsel later reviewed aspects of Berg’s conduct, while prosecutors declined to pursue charges in that matter.

Berg ultimately lost his County Board seat following the 2024 election and recount.

Garden Of Eatin Charity Controversy
Another major chapter in Berg’s history involved Garden of Eatin-Kenosha, the nonprofit organization he operated.

KCE spent years reporting on questions surrounding the organization’s finances, unpaid obligations, nonprofit status and alleged personal use of charitable resources. Kenosha Police eventually recommended felony theft charges after investigating allegations that Berg had used donated funds for personal expenses.

Berg was eventually charged with felony theft, but that criminal complaint was dismissed at his December 2025 initial appearance after his attorney challenged its legal sufficiency. Court Commissioner William Michel II agreed that the complaint was deficient, and prosecutors did not subsequently refile the case.

Judge Chad Kerkman Has Publicly Supported Berg
Kenosha County Circuit Court Judge Chad Kerkman, currently the deputy chief judge for Wisconsin’s Second Judicial District, has publicly supported Berg over the years. Wisconsin Court System records confirm Kerkman presently serves as deputy chief judge for the district encompassing Kenosha, Racine and Walworth counties.

A Facebook screenshot obtained by KCE shows Kerkman donated to Berg’s February 2021 fundraiser titled “Andy’s Birthday and Property Tax fundraiser-Garden Of Eatin Kenosha.” KCE previously reported that Kerkman had donated to and helped raise money for Berg’s Garden of Eatin operation.

In another Facebook comment, Kerkman offered Berg personal encouragement, writing, “I love how you are living your authentic life in your own way.” Kerkman called that “a recipe for success” and told Berg, “Keep being the example we need to see.”

Kerkman and Berg have also appeared together in social photographs previously published by KCE. KCE has previously described the two men as longtime friends.

There is no indication that Kerkman is accused of involvement in the conduct underlying Berg’s newest arrest.

Berg Sought Money Online After Arrest
Following his December 2025 arrest, Berg launched a GoFundMe seeking money for his legal defense and other expenses. In statements associated with the fundraiser, Berg blamed his ex-wife and prosecutors for portions of his situation while also acknowledging that his own “decisions” played a role in his arrest.

Berg later sought to reduce the $75,000 cash bail posted by his father so funds could be freed for attorneys. The monetary condition remained in place.

As of Wednesday morning, Berg was again sitting in the Kenosha County Jail following another KDOG operation at his home and facing seven new felony recommendations.
