Man Involved In Death Of Two Children Charged With OWI Monday – Seemingly Avoids Serious Charges

A Beach Park, Illinois man was charged February 24, 2023 with operating while intoxicated, a result of a crash that killed two small children and caused severe injuries to their parents. On November 18, 2022, 52-year-old Dwight Goble was involved in a car crash that lead to the deaths of 4-year-old Adrian and 9-month-old Eliana Ruvalcaba. Their parents, Krystal and Jose survived.

Gobel was booked into the Kenosha County Jail that Friday night at 11:40pm. The following Sunday the Kenosha DA’s office likely didn’t think they had enough evidence to hold him, and released him at 11:13am. The Pleasant Prairie Police Department initially referred at least one felony charge for Goble, but as of Tuesday night, no criminal charges have been filed. OWI 1st in Wisconsin is a non-criminal forfeiture. The delay is likely caused by the police and prosecutors waiting on toxicology labs.

KCE reached out to the Kenosha DA’s office, Pleasant Prairie Police Department, and the defense attorney and we did not immediately hear back. Goble is being represented by Sheboygan Attorney Dennis Melowski. Goble has plead not guilty and has requested a jury trial. OWI first is the only ordinance violation in which one can request a jury trial. Goble and his attorney elected to bypass the municipal court and go straight to circuit court. Judge Richard Ginkowski signed a $36 jury request order and his clerk Melissa Roy filed the action in Circuit court on March 13, 2023. The prosecutor will be Donald Mayew, the Pleasant Prairie municipal prosecutor.

Goble is first due in court on April 21, 2023 at 9am for a status in front of Judge David Wilk.

The family has set up a go fund me to help with medical bills and other expenses.

If you actually know the whole picture your the POS quick to judge from a news article and the pulled out in front of him and wasn’t charged for speeding he was driving a 3500 Ram truck that weighs 7500 lbs that isn’t no matter the situation going to stop all of a sudden if he was OWI or not.     1. The evidence that he was under the influence is in the blood testing at the lab that has not returned yet. At that point the charge will be issued .

If alcohol or drugs are not a factor in causing the deaths then the prosecutor would look at the negligent homicide law: “Whoever causes the death of another human being by the negligent operation or handling of a vehicle is guilty of a Class G felony.” The word “negligence” in the criminal code means means “ordinary negligence to a high degree, consisting of conduct that the actor should realize creates a substantial and unreasonable risk of death or great bodily harm to another.”

    The DA needs to evaluate whether there was ordinary negligence to a high degree.

      1. Then perhaps have your legal guardian, payor, or other intelligent person read it to you a few times, explaining anything necessary whenever you raise your hand? It’s difficult to be an adult, but that doesn’t make the world simple.

My guess is that this article will do exactly what I feel it was intended to do, alert folks to what could go wrong and put some pressure on people that are responsible for future charges when all results are in. It’s premature to say there’s something wrong, but I don’t feel it’s too early to remind people of what is at stake.

    1. False. I worked with a guy who had alcohol in his system and a lady blew a stop sign and plowed into his car and she died from the crash. But he was intoxicated so even though he didn’t cause the accident, he still went to prison. This was in northern Illinois I believe.

  4. If the driver pulled out in front of him and the accident was not his fault, he can only really be charged with OWI. If he would have pulled out and caused the accident its different story.

  5. Being charged with OWI and being at fault for the accident are two separate issues. He was not at fault for the accident, the other driver was.

  7. This is a very sad situation for all parties involved. Mr. Mathewson you profess to be a journalist, investigator and a disciple of Christ. I think before you post you should get your facts straight. Jose ran a stop sign going 46 miles an hour. Why did he do that? Could he have been distracted? Dwight’s blood work came back clear. As much as we all don’t want to see the deaths of 2 innocent children, the responsibility lies in the hands of their father. This was a horrific accident. The right thing for you to do is apologize and remove this story. I see a lawsuit here. I’m wondering how long you will leave this post up. Again, integrity and truthfulness goes a long way. Especially in this world of bad journalism.

      1. It’s not necessarily that the information is incorrect, it is misleading. Why weren’t all facts mentioned? Dwight was not the reason for the accident, why not mention that? Why not mention that the father of these children did not stop at the stop sign ultimately leading to the accident? Why didn’t you mention that Dwight’s reaction time was actually FASTER than average reaction time which is the reason he “seemingly avoided serious charges”. Why avoid the very things that proves the innocence of the man that already has to live with this trauma for the rest of his life?

          1. I question the need to even post an article with only a portion of the facts.

            Romans 16:17-18 says:

For such persons do not serve our Lord Christ, but their own appetites, and by smooth talk and flattery they deceive the hearts of the naive.

            The first comment on this post is wishing death on an innocent man because of the way your article was worded. Not sure how you’re happy about creating this division within the people, but I will pray that this conversation impacts your future articles.

        1. At least he isn’t gonna mourn for the rest of his life. At least he will see his children/ grandchildren grow up. He’s not gonna have those empty seats at his dinner table for family get together. Don’t have too much pity on him.

    1. All of this just makes me sick. These are 2 beautiful babies that were taken too soon. Dwight is not too innocent. Everything is public record. Maybe his employer should consider drug testing him every once in awhile. I’ll leave it there.
