Kenosha Man Makes First Court Appearance After Shooting At Neighbors While Drunk, High, And On Crack

Early Thursday morning, at 12:50 a.m., 9-1-1 calls came into the Kenosha Police Department complaining of shots fired inside an apartment complex on 60th St in Kenosha. A woman told police that the man in the apartment next to hers just shot into her apartment. She heard about 9 gunshots.

Kenosha Police arrived on scene and 60-year-old Gerald Rivest began threatening to shoot officers and yelled out “full metal jacket,” which is a type of bullet. After about ten minutes, Rivas surrendered and came out of his apartment. He was placed under arrest. The man that lives across the hallway from Rivest told police that Rivest admitted to smoking crack.

Rivest told police he had bought the gun three months ago. He said he was going to use it to commit suicide. He wanted to see how it shot, so he fired out of the window. He then wanted to see how it shot into drywall so he shot several times at his next door neighbor apartment and several times at his neighbor across the hallway. He admitted to police to drinking rum, smoking pot and consuming cocaine. Police took his blood pursuant to a warrant. Rivest told police that he probably ruined his neighbors’ lives by scaring them and risking their safety. Police went into Rivest’s apartment and located 12 spent shell casings.

Rivest was charged today with three counts of first degree recklessly endangering safety with a dangerous weapon, threat to law enforcement officer with a dangerous weapon, failure to comply with officer’s attempt to take person in custody, and possession of a firearm while intoxicated.

Carlie O’Donnell from the Kenosha DA’s office told the court that Rivest poses a serious risk to the public, saying “quite frankly, the defendant is lucky the charge coming to this court today isn’t homicide.” She asked for a $75,000 cash bond.

Defense Attorney Benjamin Schwarz asked for a lower bond telling the court that Rivest has had two heart attacks in the last two months and significant lung issues.

“Looking at this, this is a very serious, what’s alleged in this criminal complaint from reviewing it. Mr. Rivest, you put yourself and law enforcement and the community at substantial risk,” said incoming Kenosha County Circuit Court Commissioner William Michel. Michel agreed with the prosecution and set Rivest’s bond at $75,000 cash. He faces almost 70 years in the Wisconsin Prison System if convicted of all counts.

Rivest is due in court on April 28, 2023 for a preliminary hearing.

        My son is a cop in a wealthy suburb. The majority of 911 calls are domestic violence calls. Usually waving guns and occasionally a knife. Probably 10-1 gun/knife.

        The astounding number of DV calls is very disturbing.

        The violence is pandemic to be sure whatever your weapon. Gun, knife, fist.

        The guns allow a less personal assault than knives and hand to hand.
