Not Guilty: Kenosha Pastor Acquitted Of Sexual Assault

A Kenosha County Jury has found a Kenosha Pastor not guilty of repeated sexual assault of a child. Today, Monroe Mitchell III, 62, of Kenosha, smiled after the Judges uttered the words “not guilty.” His family and friends, who were present in the courtroom rejoiced and celebrated. “Not guilty!” they shouted in the hallways and outside. Mitchell, lead pastor at Agape Love Christian Church here in Kenosha.

The verdict came after less than three hours of deliberation and a day and a half of testimony. Mitchell was accused of sexually assaulting his step granddaughter from 2020 to 2022.

On September 16, 2022, Mitchell was charged with Repeated Sexual Assault Of A Child and two counts of Attempted Fourth Degree Sexual Assault. He only stood trial for the felony. The complaining witness, who was 14-16 at the time of the allegations, was 18 when she testified today. She told the jury of several occasions when Mitchell grabbed her but and touched her on her upper thighs close to her groin area.

The prosecution’s trial strategy was that the jury should believe the woman because “women don’t make up sexual assault allegations…She came here today and told you the truth,” said outgoing prosecutor Alexandra Smathers. The trial had previously been delayed to to late evidence from the prosecution.

Mitchell’s attorney, Aileen Henry, of Kenosha, told a story of a teenage girl who wanted out of her grandparents’ home because they had strict rules, such as “phone curphews,” limitations on activities, and chores.

The jury, seemingly believed Mitchell, who testified today. He agreed with a lot of what the complaining witness said regarding some of the factual scenarios, but adamantly denied any improper touching.

Mitchell is a convicted felon, having spent time in prison, and has asked for a pardon from Governor Tony Evers. The pardon was denied once this case was charged. Mitchell will likely ask for a pardon again. His criminal history of charged and convictions are as follows:

The jury, however didn’t hear any evidence of these charged and convictions. Mitchell is the father of Sharmain Harris, a violent convicted felon, who was in court today. This is Smathers’ final trial as a prosecutor. This was also the co-prosecutor in this case, Alexis Bauer’s final trial in Kenosha.

  3. We’ve got to stop wasting taxpayer time and money on unwinnable cases.

    I won’t claim to know whether or not the pastor did anything inappropriate, but this was a case of he-said-she-said. If you’re going to drag a man’s name through the mud and put on an expensive trial, you need proof beyond a reasonable doubt, not just an accusation.

    I’ve heard that Smathers (and Kenosha in general) has a reputation for going to trial with lone accusation and losing. This doesn’t benefit anyone, and hopefully that practice stops under Xavier Solis.
