KENOSHA, Wis. – Andrew Berg, a former Kenosha County Board Supervisor and correctional sergeant, was fired by the Wisconsin Department of Corrections last fall after investigators discovered he printed a background check on Kevin Mathewson, editor of Kenosha County Eye, during work hours — a potential criminal act if law enforcement systems were used.
Witnesses told internal investigators that Berg printed the background check from a DOC computer at Racine Correctional Institution on March 26, 2024, around 11 a.m. They also reported seeing political flyers, non-profit paperwork, and other non-work documents littering his desk. Berg admitted he “probably” used state resources to conduct political business and store campaign materials — violations of Executive Directive 50, which governs DOC employee computer use.
Asked why he saved campaign documents on his government computer, Berg told investigators: “Because I’m an idiot.” Moments later, he clarified: “Because I was scared of losing a reelection.”
Whether Berg used confidential criminal databases such as CIB or the FBI-linked TIME system to obtain Mathewson’s background remains unclear, but if he did, it would constitute a felony. Mathewson, a licensed private investigator, said he is actively investigating the possibility that Berg broke state or federal law.
Berg’s termination followed an extensive internal affairs investigation. The DOC reviewed hundreds of emails, computer logs, and documents saved to his work computer between January and April 2024. Investigators found at least 10 emails sent from Berg’s DOC account containing campaign materials and opposition research, including information tied to his County Board opponent, Felix Garcia.
Emails show Berg used his state account to communicate with printing companies about election mailers, forward campaign questionnaires, and store draft schedules for political events. One document saved on his DOC hard drive was titled “Andy Berg Bio” — a résumé-style write-up he used for county campaign work. Another was a fundraising letter to a local church requesting support for a mental health facility in Kenosha, on official County Board letterhead.
The DOC concluded Berg engaged in serious misconduct, including unauthorized political activity on state time, misuse of government computers, and storage of personal files on DOC servers. In his termination letter dated October 14, 2024, DOC officials cited repeated violations of department policy and prior suspensions for misconduct. “Your behavior represents a blatant disregard for the employer’s expectations,” the letter read.
This is hardly the first time Berg has been in the hot seat. In December 2023, Kenosha County Eye revealed Berg was producing homosexual pornography under the alias “Sergeant Hard” while working as a DOC sergeant. In 2021, KCE reported on Berg’s misuse of a nonprofit he controlled, alleging that he personally profited while failing to maintain proper transparency. Berg is still under active criminal investigation for embezzling funds from that same nonprofit.
He was also sued in 2023 for allegedly stiffing his attorney out of $10,000 in legal fees. In 2024, Berg lost reelection to Felix Garcia after a recount confirmed Garcia’s win. Mathewson successfully sued Berg in April 2024 for refusing to release public records from his time on the County Board, winning a case that resulted in the forced disclosure of official correspondence.
Despite all this, Berg remained employed by the DOC until October 2024, when Warden Rob Miller approved his termination. Records show Berg had previously been suspended for showing R-rated movies to inmates and failing to properly report to work.
The Wisconsin Department of Corrections, under the leadership of Gov. Tony Evers (D), delayed releasing the internal records related to Berg’s termination for months. The documents were finally released last month following persistent public records requests — which is why Kenosha County Eye is only now reporting the full extent of the scandal.
Now, with evidence that he printed a background report on a journalist who frequently investigated him, new questions are emerging: Did Berg access protected databases illegally? If so, he may face criminal charges.
Kenosha County Eye has filed additional records requests and is exploring legal options to determine whether Berg’s actions broke state or federal law.
